Then thank Vauban.
Then - if you feel confident - you will probably have to take them to court yourself.0 -
Hi all,
This is my first ever post so please excuse any mistakes or oversights!!!
I have looked through numerous posts but have not been able to find an answer so im hoping someone can help.
Basically, i wondered if a bird strike to the original plane, leading to a delay is treated as an extraordinary circumstance and therefore makes a compensation claim a no-go!!! The airline said this was the reason for the delay leading to a 7 hour wait for a new plane,
Also is there any way i can get confirmation of the real reason for the delay, as i dont really trust that given by the airline, namely Thomson.
Thank-you all0 -

1) You are right not to trust Thomson
2) When you say original plane was this the flight before yours i.e.
the strike happened when your incoming plane landed?
3) Have the airline said the technical problem (assume engine damage) was the extraordinary circumstance?
4) Did the strike happen in the UK?
5) More details needed regarding date etc. before any definitive comment can be made or suggestions provided0 -
Thank-you so much for your response 111KAB,
Re your points
2. The bird strike happened to the plane on its way TO Belfast international. We were meant to board it to travel from Belfast to Corfu but were told a new plane needed to be organised.
3. We have had no information from the airline direct. One of our party knew an air hostess who said the bird was the reason for the delay.
4. Yes, the departure airport was Belfast, N.I
5. Flight was package holiday through Thomson. Flight number TOM1526 on 25/7/14. Flight departure time was 3.15pm. It actually left approx 8.50pm

Unsure about NI however assume bird strike should be reported to CAA therefore, for once, it may be worth approaching them. Check on the Aviation Herald to see if it was reported there (few are) - also as strike did not happen to your flight but a preceding one there is an argument to say this should not effect yours and a speedier replacement should have been made.0

Thanks 111KAB. In NI we are the same as the rest of the UK, so thats very promising! i will see what i can find out from CAA.
Im so glad i posted here.
Again, many thanks0 -
Im back again! I had a look on Av Herald and there is no info regarding a bird strike. I also checked for reports at Belfast airport and there is no information there either. Could anyone tell me the address or email that i contact at CAA. Also should i contact them quoting FOI act?
Many thanks0 -
I don’t know whether a bird strike must always be reported to the CAA. Worth asking them this.
But where are you going with this? What are you hoping to prove?0 -
PS This is the way to ask the CAA: and yes, cite the FOI Act.

Thanks Vauban.
Im really wanting to find out the real reason for the delay, and thought the CAA might be able to confirm if a bird strike was reported on 25 july on the inbound plane to Belfast.
Ive already contacted Thomson, but am expecting them to come back with a " sorry you're not due compensation" response, and i want to be prepared to question that.0
