To avoid wasting any more of your time, I would personally make your next letter an NBA. My experience of another airline (several years ago, before I discovered this forum) is that they will happily exchange emails/letters all day long if it avoids paying out.0 -
David is right. Any professional debtor knows that there are those letters you can safely ignore. Appealing to their better nature in the hope that they'll do the right and proper thing seldom works. It is in their interests (financially - not morally) not to pay up unless they absolutely have to.0

Just to let everyone know, yesterday I had my day in Court. To recap, 19 hr flight delay due to hydraulic leak back in 2010. Thomson case - 2 yrs and extraordinary circumstances. Unbelievably, they did not apply for a stay and turned up in Court requesting a stay. Our Judge was brilliant she basically said that the case was going ahead as Thomson's had had every opportunity to request a stay before the hearing date. She was quite clear that even though an appeal had been sought from the Supreme Court, it had not been granted and therefore we had provided enough case law for her to hear the case. In summary, we won - plus 8% interest compounded for the 4 years that Thomson had made us go through hoops. Thank you so much for to all the contributors on this site especially to Vauban for posting his full witness statement which we were able to adapt and use. I am more than happy to offer assistance to others if you wish to contact me. Thanks again and hang on in there.

I think your Judge needs to be held up as a shining example of how the Courts should work.
In my hearing last December Thomson requested a stay on the day and the Judge made similar comments about having time to formally apply for a stay prior to the hearing. He did however, grant the stay but also mildly rebuked Thomson for the late request. Consequently he did award to us travel and witness appearance costs for Thomson wasting a hearing that need not have taken place if Thomson had followed the correct stay application procedure in good time.The above is just my opinon - which counts for nowt! You must make up your own mind.0 -
We have just been informed that our flight to Cancun from LGW tomorrow is delayed by at least 5 hours. Scheduled to take off at 12:55 is now 18:00.
We are flying down to LGW from GLA tonight and staying overnight in a hotel.
The question is, should we still check in earlyish....and would Thomson give us vouchers to spend at the airport ( if so...how much ) or hang fire and check in later, saving waiting around an airport.
Also....depending on the circs of the delay ( one flight from LGW-CUN delayed today 25/08/14 9 hours ) and now a further 2 flights are delayed....should we claim compensation ?

I have had a read at Thomson compensation. They do NOT class a change of flight time ( 24 hours or less ) as major unless it is delayed 24 hours or more....ours is 5 hours so far. If I have read it right we are due nothing before travel.....
* A delay to your flight that we need to make within 24 hours before you are due to depart will not be considered a major change unless the delay is for more than 24 hours. These changes are only examples and there may be other significant changes which constitute major changes.
*Compensation
Any compensation payable will be on these scales, based on how many days before your booked holiday departure we tell you of a major change.

Hi everyone, I could use some help please! I was delayed in 2012 for 30 hours on my return flight to the UK. Thomson denied compensation as try said the plane had a technical fault and it's extraordinary circumstances. I wrote to them again recently after I read in here that they cannot use that as a reason not to pay compensation but they just printed the same letter from 2013 and resent that as a reply to me!
The other question I have is that I asked the Thomson rep if we could cancel our flight (we were flight only not a package hol) and book another flight home and I was told no and that if I did this I would not be entitled to a refund. When I returned home and read up on the delays I found out that I should have been granted a refund to enable me to make my own travel arrangements home. I have asked them about this on all correspondence and on their first reply they said they would find out and get back to me, however on all further replies they keep avoiding the question and not answering it.
Any ideas or should I just now go straight to court?
I was especially annoyed with them as it was our honeymoon and they treated us poorly and although our hotel stay was fab (booked through Virgin) the delay and treatment we receive from Thomson made it end on a real low point.
