Flight delay and cancellation compensation, Tui/Thomson ONLY

    I flew with Thomson to Palma, Mallorca from Edinburgh on the 26th July this year - when we checked in (0540am flight), we were told that the flight was delayed an hour due to 'a backlog of flights from the day before'. The flight was then delayed a further 3 hours, with no advice or updates given from any Thomson reps etc. From what I could see (from looking at the gate the flight was due to leave from), they were waiting for the aircraft to arrive. When we boarded, we were told that the delay was due to 'catching up' with flights from the day before.


    Do you think this is a valid reason to claim? 4 hour delay in total.

    If you want to do it yourself then set your own timescale for Thomson to respond. As you have already found out letter writing is a waste of time as it gets you nowhere.

    Send an NBA and give them 14 days to settle, then start a court claim. I'll wager you'll get a response then.

    Yes, although you haven't said what the reason for the backlog was. Was it because of delays from air traffic control strikes? If yes then the airline will claim extraordinary circumstances and not pay but you still have a valid claim.

    You should try to find out the reason for the backlog in the first place and if other Airlines were also affected. If it was just Thomson, you may have a valid reason to claim. However it could be considered a "knock-on" effect and out of their control.
    This is only my opinion, others may have better advice to give you.

    Yeah all they said was that it was due to flights being delayed from the day before.


    How would one go about finding out why there was a delay? Is it as simple as asking the airline?

    Looks like you have a valid claim but register (free) and look on flightstats to get an overall view of flight delays over the two days in question at PMI. Thomson will not clarify reasons for delay over and above what you already know.
  • Hi, any help with this one would be most appreciated.
    We went on a family holiday to Turkey last month. It was a package holiday booked with Thomsons holidays. When i recieved the booking details from Thomsons, it stated that we would be flying with the Turkish airline ONUR AIRWAYS. Our return journey to Newcastle was scheduled to depart Antalya airport at 10.45.
    The night before, we received a message from our Thomson rep, saying that our flight was delayed until 14.00, and therefore our hotel pick up would be 3 hours 15 later than planned. The flight did not actually depart until 14.45 (4 hours later than originally scheduled). We were not told the reason for the delay.
    In order to claim, i believe that the flight either has to depart from an EU airport (which it did not), or it has to be an EU airline landing at an EU airport. This is where it gets complicated, because ONUR AIRLINES is not an EU airline. However, i did not book with this airline, i booked with Thomsons and they presumably chartered ONUR AIRLINES for their passengers.
    The other question i have is regarding the fact that Thomsons gave me about 17 hours notice of the delay. I believe that they have to give me 14 days notice. If anybody could confirm this i would be very grateful.

    Does anybody know whether making a claim with your travel insurance provider for subsistence costs approx £60 (30 p/p) will affect being able to make a claim with the airline?

    I have checked the FAQs for this however I cannot find the answer!

They answered the outbound letter within 14 days which I am going to pursue, but was waiting on a reply to the inbound letter which still after sendig it recorded delivery, again first class and by email, still nothing.

    If anyone has any tips I'd really appreciate it.
    Hi Cupcake77 we were on the same flights as you both delayed. Wrote to Thomson in May, received a standard letter, but for a flight to France!!!!. Have written twice more no replies so NBA letter going to them today. Will take this through the courts. Suggest you write a NBA letter then take them to court. I would love to know the reason they gave you for the delay to the outbound flight, if you could PM me i would be grateful.
