In 2008 we flew from Newcastle to paphos Cyprus.

We left Newcastle on time except after 4 hrs flying the pilot came over the tannoy saying that we need to do an emergency landing in Manchester! !! We flew around the UK burning fuel.

The plane had an apparent faulty washer causing a light to go on and off in the cockpit. We stayed in Manchester for about 4 hrs. This was because Thompson decided to send out faulty plane after being fixed to another destination as it would have been late getting back from Cyprus. The airline then left the passenger mafist on the plane.
We then had to wait around until they could obtain another copy. We did not arrive in Cyprus until 11.30pm instead of the 11.30am.
To top this off on the way back they had no food due to a mix up and would have delayed us going back if they waited for food.

I did complaine back in 2008 and got a crazy hamper for the kids.

    What are your thoughts guys

When in 2008 was your flight? If it was early in the year then you are too late to start a legal claim.

Otherwise read the FAQ's on page one of the dedicated Thomson thread (note the spelling) and post any further questions on that thread.
The above is just my opinon - which counts for nowt! You must make up your own mind.

The flight time to Cyprus is only just short of 5 hours. If you had been flying for 4 hours then there was no reason to burn fuel because you had used enough fuel to be in the landing window weight and somewhere over the Med to boot.

What Thomson have written is correct and the same has been printed in their brochures for some years so you can forget any conspiracy theories in this regard, Bonters.

Well, it's about time their information was corrected then! Just proof again of their incompetence.
  • I have been declined by Thomson due to a faulty plane. After the new ruling is there a template to resubmit my claim?

You don't need a template. You simply write again to say that, following the Court of Appeal ruling in Huzar v Jet2.com you would like the airline to reassess your claim. Of course they will likely stall and say that they will not be able to do so until the possible appeal to the Supreme Court is sorted. And even then they'll probably say no.

You should really be starting court action, not wasting stamps. There's a NBA template in the FAQs on page one.

It was July/August and I thought we would be landing in Italy or somewhere like that area. You can imagine the uproar on the plane when he said Manchester

Attention To Detail - It is important. Do not put 'Thompson Airways Limited ' on any court documents! That is not their name. (Although on several occasions that is what has been incorrectly put by my local court).

After seeing the above information, I got my bundle out which is all ready to pass to the court and Thomson next week. I thought I would amend the first pages on my Witness Statement and Skeleton Argument where I had put Thomson Airways Ltd! Obviously I would only have to print off the top pages, so wouldn't be a big job!

Before I did so, I checked letters received from Thomson Airways. Although at the top of their letters it says just Thomson Airways, at the bottom it says Thomson Airways LTD!

So, I'm not going to bother! Just let somebody try and tell me that I have got it wrong! I'm ready for them!

Well you need to work out exactly when the flight was, because that date will be your deadline for filing a claim with the court. If you don't lodge a legal claim by then, it's over. And you'll have to do this yourself - you're too late to engage a NWNF lawyer. (Of course, if the Dawson Appeal goes the wrong way tomorrow then you will already be nearly four years out of time!),

Just checked with the Mrs was Sunday 16th September 2008
  • Hi

We have been fighting this now for over 9 months.

We were delayed in Orlando Sandford for over 6 hours with a 2 year old. From the minute we started checking in we knew there was a problem as we were taking ages to even get to the desk. When we eventually got to the front of the queue we were told it wasn't even our plane which had a problem but an earlier flight to another airport so they were taking our unaffected plane. This meant we had to wait for another plane to be sent over.

We went through the usual routes of templates to Thomsons which was rejected due to technical issues. The case was then passed to CAA who after doing their stuff came back with the same conclusion. We then decided to instruct a company to sort this out for us but, they decided to wait for the ruling on the Jet2 court case, and now this has gone in the favour of the claimant they are putting in for a court date. We are now quietly confident but waiting with bated breathe. :j
