    Yes, probably.
But this was a Virgin flight and you have posted in the Thomas Cook thread?

Thank you for the information, would the right course of action would be to send the letter of notice now and see what happens? Quite lost on what to do now!

    Thanks,

Yes. page 6 of Vaubans guide if they refuse you can then go to CEDR before going to bott&co or euclaim nothing to lose by sending the letter. Thomas Cook has signed up to an arbitration service but we can discuss this if they refuse to pay you.

Dear all who were on that flight and seeking compensation from Thomas Cook.

I complained too and I got the same response from them that the flight was delayed for 2 hours and 59 minutes only, not 3 hours, therefore no compensation was offered.
However I know this to be incorrect as i am sure the doors were opened after 3 am.
I emailed customer services at Antalya airport and they confirmed to me in a formal email that the arrival time was 02:57 am. as you are aware we were scheduled to arrive at 11:55 pm, so the delay was 3 hours and 2 minutes.
I communicated this to Thomas Cook, with a copy of the email, but they did not respond.
I have now escalated the case and will await their response.
I am willing to take this to the Civil Aviation Authority if they continue to deny the delay.
Today I have also found a website that archives flight information and it clearly details that the flight arrived at 03:08. I've taken a screen shot of the web page and attached this.
    The web site is airportia.com
    Hope this helps
    Thanks all.

If you believe you have a case and it would appear so download vaubans guide and send them a letter before action explained in the guide and get the ball rolling otherwise you will end up playing ping pong with all the different bodies. CAA is as useful as a chocolate teapot

Would it be possible to get a copy of that email from Antalya Airport so I can add it to the CEDR Dispute, I already have the Airportia details.

    Many Thanks

Mandy 68 advice has been given it is now time to issue a letter before action otherwise you will get nowhere.
  • Does anyone know if TUI are responding to any claims submitted through Resolver?

I raised one on 26th June for a 4 hour delay from Prevesa to Gatwick but its been radio silence since despite chasing once already through Resolver. I've not even had an acknowledgement to say its been received.

If its known TUI won't respond to claims via resolver can we get this published on MSE so people aren't losing time when they need to go directly to TUI?
