Cant seem to find anything that relates to this claim so any help would be great
Arrived at destination (turkey) over the 3 hours
Original delay was 4hrs from gatwick
Flight was delayed as we had no plane due to a problem with our plane at Dalaman (didn't arrive at Gatwick)
Boarded alternative plane 2hours after original take off time
10 minute storm at Gatwick 2hours 40minutes after original take off time
Finally took off 4hours after original take off time (waiting for take off slot)
Thomas Cook using the 10 minute storm as the excuse , I have stated that the delay was caused by no plane .....

have you checked the NWNF free checkers to see if they believe compensation is due? (EUClaim, bottonline)
Often in cases with multiple reasons for delay the airlines will apportion the time...eg how long no plane? how long weather? how long ATC? The first is within control and the other 2 are not so you would need to show that the element within their control accounted for over 3 hours
Challenge is that, had they not had the delay waiting for the plane they would likely not have been affected by weather or ATC
Check the NWNF sites and if they both confirm compensation is due have a read of Vauban's guide for next steps0 -

Hi Guys,
New to this forum so forgive me if this has been asked.
Me and My wife were delayed from Hurgarda to Manchester for 16.5 hrs with Thomas Cook on the 18-08-2017, We Have started a compo claim with TC thorugh Reslover (very good service i must say).
We have now recived a relpy from TC saying the delay was caused by Air traffic control and therfore it is not there fault and will not pay.
Now the thing is we were given 2 letters from TC during the delay (1 in Hurgada and 1 in Manchester) The 1st letter says the delay was caused by a tec fault in Hurgarda and had to be fixed before take off. The 2nd letter recived in Manchester says Tec Fault, Adverse Weather,and lastly Crew out of hours..
Is TC trying to just cop out of paying or do i still have a case with the letters i have..
Was anyone else on this flight and have you had the same responce???

If you have those letters, make continue with the claim. There may well have been an ATC issue but only after the tech issue(s)
Escalate but you may now need to go down the legal route or and ADR if TC are signed up to one.If you're new. read The FAQ and Vauban's Guide

I have the exact same problem with the flight to Hurghada. Kept all letters, Thomas cook refused claim so have taken it to CEDR. Any ideas on whether it will be successful?0
