I was on this flight and also made a claim which was denied for the same reason given to you.
I have lodged an appeal against this decision today as the reason is total nonsense and will await their response.
I am also attempting to locate a copy of the weather report for the day of the flight to add this to my claim.
We were advised by staff at Man airport on the day that the delay was due to Dreamliner aircraft not available as they were in Cuba !!
If I don't get a favourable response then I will pass it to a claims company to deal along with a claim refused in March this year for a four and a half hr delay.0 -
Just an update.
Within 5 working days of them acknowledging my claim they transferred 2 x 300 euros into my bank account.
I've since emailed them stating that it should be 2x 600 euros via their online complaint system as they didn't acknowledge my original email.
I'll wait and see what the outcome is before I go down the CEDR route.0 -

Yes, many airlines will try and get away with conning passengers on delayed flights that the clock stops when the wheels hit the runway, as that is the stated landing time.

I had understood that the stated landing time on e.g. flightstats is not when the airplane touches the runway but rather when it's come to a stop at the stand. You're right that the method for calculating arrival for 261/04 claims is when the door is first opened.0 -

No reply as yet from thomson to my last (been 4 weeks) to them. Apparently after 8 weeks we can go to cedr . Good luck with your claim. S0 -
Flight delay over 3hrs .Crew told us that our plane was late inbound from Orlando adding " due to previous storms extra passengers needed to be brought back.".
Plane took off well over 3hrs late they allowed a large group of drunk foul mouthed men and women to board ( they had spent the delay time drinking ).
Landed in Las Vegas Pilot told us we would have a little wait as due to delay he had to wait for another plane to move so he could park in his spot.
Wrote to Thomas Cook as soon as we got home reply - delay due to security issues ,therefore they did not have to pay compensation !!!!!.
Others who claimed told - Us immigration insisted that 3 passengers were off loaded at the gate !!!. This did not happen.
Truly disgusted by Thomas Cooks response and have e mailed again still waiting for a response .0 -

What was the scheduled arrival time and what time was the first door opened upon your arrival at Orlando? It doesn't matter how late you depart.
If between 3 and 4 hours, the compo can be halved. If less than 3 hours, no compo due. Full compo due for 4 hours and over. All subject to no claim of extraordinary circumstances from TC.

We landed at Las Vegas Airport 8mins before the 3hrs rule ,but doors not opened for another 15 minutes at least so we definitely went over the 3hrs delay.
Thomas Cook claim security issues for delay "US Immigration insisting 3 passengers off loaded at gate " No passengers got off separately, we all got off when doors opened.0
