Can I just ask what proof people had that they travelled with TC? I posted a thread on the main board and a reply said that I can pay a fee of £10 and get details of what information TC hold on me. The reason I posted is that I no longer have the confirmation email of my booking and as we flew in 2007 I no longer have the boarding passes so by paying the £10 I may be able to get details of my booking ref. My other thread is headed "Gutted" where there are further details about what I've had from them so far.

    Thanks

    Ian

    The £10 thing is HERE

Sorry if this is in the wrong place but I'm new to this.

I have been offered £720 compensation for a delayed Thomas Cook flight from Majorca to Manchester in 2011. The only problem is that they have sent me a holiday voucher instead of a cheque (despite making it clear in my complaint letters that any compensation should be paid by cheque). Can anyone confirm that I am within my rights to send the voucher back and insist the sum is paid to me by cheque only? Has anyone had a similar experience? Any advice would be really appreciated.

Yes the Regulation states that they can only send you vouchers if they have your written consent, so they should now sent a cheque.

My partner & I had an 8 hour delay in October to Paphos from Manchester due to a technical fault on the Thomas Cook flight. Eventually we were flown by Thomson instead.
Would that be Tuesday 16th October? - it was 7 hours 20 minutes according to flightstats ;)

Thanks to the fantastic advice on this site I followed the initial procedure and received a reply from Thomas Cook saying compensation was denied because the flight was delayed due to 'extraordinary' circumstances.
    Me too!

I then followed the next template and wrote to the CAA who followed it up on our behalf.
I've not tried the CAA as everyone says they take months to reply - maybe as it was 5 months ago, I should have done :o

We have today received a letter from Thomas Cook saying after reviewing the case again they would like to offer us £720.
    Congratulations!

Needless to say we are extremely pleased with the outcome and can't believe how easy it was!

Congratulations. We were on this flight 16 October 2012 and have been writing and waiting for a response from CAA since November. Please could you be so kind as to forward me a copy of your letter from CAA and Thomas Cook via PM ? Many thanks in anticipation.:j

And how did that work out for you?

If you want your money you send one letter and sue 14 days later.

Yes, I know that, but the flight was booked in my wife's name and she doesn't think it's worth pursuing

Shall we say that I'm 'acting on her behalf' :D

How fortunate, having such a wealthy wife who can't be bothered to ask for the hundreds of pounds just waiting for her to accept. ;)

I too have PMd Bunerk and hope they respond. I will be phoning the CAA in the morning to chase up my complaint which has been lodged with them since November. Thanks JB for keeping everyone in touch over this.
  • delayed 8 1/2 hours vancouver to london may 2008. thomas cook said claim off the company who you booked with, (canadian affair.) canadian affair very helpful and replied by return of post not their responsibility. Informed TC of CA reply. Received a letter today from thomas cook apologising for delay and stating that 'in line with our obligations under Regulation 261, i would ask you to accept the enclosed voucher for £1090.'
i see this as TC admitting liability, and i shall return the voucher and press for 1200 euros cash, which is my entitlement. The regulation states that vouchers are only acceptable if agreed by both parties.
the terms of the voucher are valid until 8/03/2014 and must be fully used in 1 transaction.

TC has filed a Defence in my case. They are claiming extraordinary circumstance applies. There is still no technical information.

Phone the court clerk and ask if what they have submitted constitutes a defence, and if not, can it be struck out and you apply for judgement by default?
