Can I just ask what proof people had that they travelled with TC? I posted a thread on the main board and a reply said that I can pay a fee of £10 and get details of what information TC hold on me. The reason I posted is that I no longer have the confirmation email of my booking and as we flew in 2007 I no longer have the boarding passes so by paying the £10 I may be able to get details of my booking ref. My other thread is headed "Gutted" where there are further details about what I've had from them so far.

    Thanks

I would think that failure to cooperate or respect the NEB is just about an admission of guilt! If I owned an airline and the world and his dog were lining up to sue me, and I was convinced I was in the right, I would go out of my way to cooperate with the NEB, after all if they agreed it was ec we would be snookered. I would think their obstructive behaviour to yourself as well hardly helps their cause. I just cannot see what they are up to, short of hoping they get a judge too full of vino after his lunch, I cannot see what their tactics are. Hang in there.

Yes the money would be nice but it is the principal of it. They will not admit they are wrong even though I have two Air Mechanics tell me it is not exceptional circumstances. Perhaps they are being so nasty because I got somebody else's opinion. They must be hiding something not answering the CAA

I didn't have any proof just the the booking reference, have had a few replys but no compensation as yet.
  • I have tried the direct approach and received the usual generic replies. My last e-mail gave them 7 days to reply to my previous letter with either an offer or a detailed reason for a denial or I was going to MCOL. No surprise that I received another generic reply. My question is that now that I have referred to me taking the matter to the small claims court do I have to send a formal LBA to the Peterborough Address before I issue on MCOL? Any advice appreciated. Thanks

Interesting. I have looked i their website and the address of where to write to for information held is given and it says there is a £10 charge - funny that because I thought the DPA said information should be available free of charge but then again it might be worth the punt.

Lucky you! :T Somehow I can't see them playing ball with me now I've alerted them to my potential claim but at least I have some hope of being able to get the booking reference.

Hi I called the travel agent who printed a copy of my booking details and sent me a copy of it. It had booking reference, dates, flight numbers and listed the names of passengers. No charge. This was for a holiday in sept 2008 so a long time ago, but was still on their system. Is this worth a go?
  • Sorry if this is in the wrong place but I'm new to this.

I have been offered £720 compensation for a delayed Thomas Cook flight from Majorca to Manchester in 2011. The only problem is that they have sent me a holiday voucher instead of a cheque (despite making it clear in my complaint letters that any compensation should be paid by cheque). Can anyone confirm that I am within my rights to send the voucher back and insist the sum is paid to me by cheque only? Has anyone had a similar experience? Any advice would be really appreciated.
  • My partner & I had an 8 hour delay in October to Paphos from Manchester due to a technical fault on the Thomas Cook flight. Eventually we were flown by Thomson instead.

Thanks to the fantastic advice on this site I followed the initial procedure and received a reply from Thomas Cook saying compensation was denied because the flight was delayed due to 'extraordinary' circumstances.

I then followed the next template and wrote to the CAA who followed it up on our behalf.

We have today received a letter from Thomas Cook saying after reviewing the case again they would like to offer us £720.

Needless to say we are extremely pleased with the outcome and can't believe how easy it was!
