    It would appear to me, that following TC getting a bloody nose by a judge in the Halsall case, they have started to pay up a lot more.

    I have just spoken with Pamela at the CAA (0207 743 6888) and she informs me that every complaint is treated on an individual basis due to the Data Protection Act. i.e there is no central database for all passengers on an affected flight to have access to any response from the airline other than their own individual complaint. This is due to a fear that protected information, such as a name, could be disclosed without authority. Therefore, although 'Bunerk' (post #880) reports a successful claim - unless they are willing to share their letter from the CAA - no other passenger can use it fortheir own claim via the CAA. :AI would therefore implore all MSE fans to PLEASE share their success letters via PM.:Aand be a MSE Angel!!

    In our own case - TCX2026 from Manchester to Paphos on 16.10.12- she informs me that TC have not replied to the CAA following a formal request for assistance lodged with the CAA on 7.12.12. and they will be contacting Thomas Cook again by Tuesday (19/3/13). I would recommend if you have a complaint lodged with the CAA and have not had a response after 6 weeks- phone them on the number supplied above. Phones are open Mon- Fri from 0900-1430.

    IMHO it is incomprehensible that a central data base at the CAA cannot contain a redacted copy of a reply from an airline about a specificflight which could then be used for all other complaints about that flight. It would speed up the process and save the CAA hours of administration/cost.

    Hi all.

    I organised a lads holiday to Tenerife in June/July 2007, our return flight was delayed by 5 hours, due to 'technical problems' with the aircraft.

    At the time it was a MyTravel flight, so I've drafted up a letter, and am sending it off to Thomas Cook

    Not too sure what to expect, I've read through a few pages of this Forum Thread, and there doesn't seem to be many success stories! Lol.

    I will keep you posted on any developments.

    UPDATE

    Thomas Cook are saying that they can't find the records of my flight, because it was a MyTravel flight (Thomas Cook bought out MyTravel). Surely the have a legal obligation here? It's not my fault they "can't find" the details!? Thoughts anyone?

    Hmmm we were delayed also on 23 June 2013, little strange that , our flight was to Cancun ( started at Bristol, then to Manchester) I wonder if were all related somehow. just getting my stuff in order ready to file MCOL,

    OK, so I started my claim, on MCOL, but cant add the other claimants in our party, does this go on particulars of claim, or have I done something wrong?

    I chased the CAA this week to find out where my complaint was up to. Unfortunately it appears that they have done nothing with it, even though they've had it for over 4 months. I've had assurances that they will now write to TC but it could take months to resolve. I'm at the court stage with my case so hopefully will get a response before the court date. I was also told that the CAA have some new staff starting next week, so that should make things quicker. Every time the right to compensation is advertised the CAA tell me that they receive a large amount of complaints, but it does seem to me that the CAA system is antiquated with no joined up approach.

    I would urge all of those that have a case with the CAA who have not heard anything, to give them a ring, dont bother emailing (I did that twice with no reply). When I mentioned the fact that my flight was due to a knock on technical fault they said sarcastically "It's not as if they haven't got a large fleet to avoid these problems is it" so they're clearly not happy with TC on the face of things. I also mentioned the fact that they gave 2 passengers on the same flight a different excuse and that didn't go down too well either!!!

    OK so I figured out, to make the claim with N1 Form, just means I have to write it all out, just in case TUI want to say the claim is invalid.

    I Keep trying to claim for a delayed flight last summer

    they claim that because the plane had a mechanical problem it counts as "exceptional circumstances" however we all know it doesn't

    yet what can I actually do about it?

    I tried the CAA however they said because the plane left from spain i have to speak to their version of the CAA however of course their the only ones not to have an email address and I have to phone or write

    It didn’t give me that option and no guidance on having to split the party, so I have put in a total claim for the whole party as per listed in my initial and follow up 14 day letters.

    Strange though as I did give them one more chance before I started MCOL last Friday morning and got the normal reply Friday night saying nothing has changed and they see no need for compensation for the steering fault that left 13 of us sat on the plane for over five hours, delaying us for over 24 hours in Barbados etc.

    So I then immediately started the MCOL, but when I got home from work on last Monday I had another letter saying that they are reviewing the case in the hope they can bring it to a satisfactory conclusion for all involved. If they told me that on Friday I would not have put in the MCOL claim that I am now claiming interest and expenses on. To late now though, I’ll see what happens after the 14 days.
