  • I am new to this forum. I have tried the direct approach and received the usual generic replies. My last e-mail gave them 7 days to reply to my previous letter with either an offer or a detailed reason for a denial or I was going to MCOL. No surprise that I received another generic reply. My question is that now that I have referred to me taking the matter to the small claims court do I have to send a formal LBA to the Peterborough Address before I issue on MCOL? Any advice appreciated. Thanks
  • Hi new to this so not sure if doing this correct my self and family were delayed 4:45 from dalaman to Manchester August last year I have sent claim to thomascook they have replied with a holiday voucher for £1260 I have emailed them back and said thanks but no I want the correct amount (£1500 aprox) in cheque not voucher how long do they have to respond and have I done the right thing

    What do they mean National Ministerial Decision of Sanctions
    National Ministerial Decision of Sanctions, nothing to get excited about, just a bunch of civil servants appointed by the government to make sure that all companies doing business comply with all rules and regulations.Theoretically they could tell TC to sling their hook, and take their grubby little planes with them, but they wont. Like I have posted TC treated the Spanish NEB in a similar way. I have written to them (they don't do emails), and have not as yet received a reply. I have also reported them to the CAA, and my local MEP. |Don't know if it will do any good, but in my opinion they are taking the Michael. What is the point in having an EU if it is toothless. REfusing to pay compensation because they believe right is on their side is one thing, completely ignoring a body set up bt a national government to ensure compliance and smooth running of its airports is another.

    That's what I thought it meant but if they don't keep to the sanctions It was a waste of time contacting them.
    Would we be able to go to court ? Would I be able to add the CAA comments? They received the court papers on Tuesday, a bit nervous about it all first time ever doing anything like this but their whole attitude as been disgusting, especially their customer service dept., & the lies they have told

    TC has filed a Defence in my case. They are claiming extraordinary circumstance applies. There is still no technical information.
  • Result!!
    Template letter mid January, one of the pro-forma replies from TC 1st February and again 18th February saying blah blah.
    Emailed them yesterday asking for a decision and this morning a voucher arrives through the letter box! Tend to think it was already on it's way though.
    Have emailed again asking for a cheque.

    I have done the same. I rec'd £1086 and was looking for £1304.
    I phoned and told them this on 27th Feb. They told me I could be waiting for up to 28 days. I am still waiting!

    SUCCESS!!

    After a long struggle - getting standard excuses of extraordinary circumstances, contacting CAA and promising small claim court action I got my voucher for £600 a couple of weeks ago. I returned this pointing out I wanted the compensation due to me. Today I received a cheque for £1075 which I will deposit immediately in case they go bust)..

    They apologised that they had just discovered that the distance from Paphos to Glasgow is over 3500 km.

    I would think that failure to cooperate or respect the NEB is just about an admission of guilt! If I owned an airline and the world and his dog were lining up to sue me, and I was convinced I was in the right, I would go out of my way to cooperate with the NEB, after all if they agreed it was ec we would be snookered. I would think their obstructive behaviour to yourself as well hardly helps their cause. I just cannot see what they are up to, short of hoping they get a judge too full of vino after his lunch, I cannot see what their tactics are. Hang in there.

    I am new to this site. I used the template to get delayed flight compensation from Thomas Cook - Dalaman to Manchester in 2011. I was delayed for 5 hours. Received a voucher for £1077 this morning going to ask for cheque though. I am also going to try and claim for a Thomas Cook flight from South Tenerife to Manchester which was delayed on Friday 5 September 2008. I don,t have the flight number details or how long the flight was delayed. But i know it was delayed for a substantial amount of time. If their is anyone out there that can help who was on that flight please let me know.
