Flight delay and cancellation compensation, Thomas Cook ONLY

    We were on a flight on 19/2/2012 from Tenerife to Manchester that was delayed for 9 hours.

    We've sent a letter by recorded delivery asking for compensation to
    ThomasCook Airlines Limited
    TheThomas Cook Business Park
    ConingsbyRoad
    Peterbourough
    PE38SB

    It's been over 3 weeks and we still haven't received a response.
    I went through the CAA complaints process, but it told me that it can only handle complaints where flight originated from the UK.

    What is the next stage?
    Who can I contact in Thomas Cook?
    Does anyone have an email address for Thomas Cook?
    Should I just go straight to small claims court?

    Give TC 14 days' notice of the issue of proceedings, and then sue.

    I know we have put our claim in using a third part. Received a e mail from the Greek Authority, they have sent another to Thomas Cook giving them 5 days to reply. Would it be worth sending this to eu delays who are handling the case for us?

    Looks OK - just fix the spelling of Peterborough' and put 'Attn. The Company Secretary' at the top.
  • I was wondering if anyone else using this forum was on this flight? I have exhausted communications with TC so will now be pursuing this through MCOL. On the flight we were given letters stating technical reasons for the 12 hour delay but the captain said it was because our plane was needed elsewhere. I suspect it might help to know other passengers should this go to court.

    Taking into consideration EC 261/2004 Regulation and the European Court of Justice Decisions C-402/07 - C-432/07 and C-581/10 -629/10, kindly be asked to: a) inform us the reason of delay and b) provide to us proof if there were extraordinary circumstances (usual technical reasons are not included) or pay the relative compensation (400 euro).
    According to the complaint handling procedure under Regulation E.C 261/2004, a case is submitted to the airline requiring reply within 6 weeks from the date of receipt. That date was on 6th December 2012 but no reply was received from your company. If no reply is received from the airline, we send a reminder adding an additional delay of 2 weeks. On 8th February 2012, we sent to you a reminder with no answer from you for one more time.
    Please respect the deadline and give us your answer in the following 5 days, otherwise we will be in the position to initiate the proceedings of our National Ministerial Decision of Sanctions against your company.

    I don't think TC do NEBs, wrote to the Spanish NEB in last summer, got a reply that they had asked TC to put there side of case. Couple of months later got another letter saying TC had not responded, but they had done there own investigation and TC should shell out. Yipee I thought, and waited for TC to send cash. No response, sent them a copy of AESA response, still no reaction from TC, so am having to go down the mcol route. Last response I had from TC was tough and it was up to the judge in the small claims court to deceide if the delay was extraordinary or not.

    To be honest centipede 100 has done a great job in providing all the advice and template letters you need, all for free, so why pay someone else to do the same job?
