    Just had it confirmed that Thomas Cook are paying me out €1600.00 for a delay of 20 hours coming back from Lanzarote back in November 2014, happy with that!!


    But they are paying me at todays exchange rate of 1.35 and not 1.25 which is what the exchange rate was at the time of the delay.


    After reading the guides, in particular Vaubans, I'm sure they should be paying at whatever the rate was at the time of delay which was 1.25, this makes a difference of almost £100.00.
    They have asked me to get some evidence of this to back it up but I can't find it, anyone have any ideas where I can get this?

  • Thanks 111KAB, sorry I maybe wasn't clear. I have this already, this is why I know the rate was 1.25 in November. What they are asking me for is evidence that they have to pay out at the November rate (1.25) and not todays rate (1.35).


    Or do you think I should just be happy that I'm getting the full pay out (4 x €400 = €1600) but just not at the better rate?


    They have once already tried to get out of paying for my infant daughter as they said she wasn't eligible for a pay out because she didn't have a seat, but then they back tracked when I told them that she was eligible.

    I am surprised they have even entertained your suggestion that they pay at a rate which is more advantageous to you!

    Not saying you are wrong - I made a successful claim against Thomson and they used the rate on the date of the delay, but my impression of Thomas Cook is that they will do anything they can to reduce the impact of having to pay compensation (hence the default "here are some vouchers" approach).

    Ah - just read the reply you posted while I was still typing.

    Not sure the legislation actually covers what exchange rate to use, and I would expect TC to use whatever was better for them.

    Certainly not worth going to court over it; TC would just claim you were quibbling over their interpretation of the rules.

    I got a reply on 27/01 saying that our claim is eligible for compensation, you will receive within 28 days and the amount will be confirmed at the time, I mailed them back saying I want the amount confirming before, I got no reply.


    So just called them today and got quite a helpful lady but she did say that they're only paying for 3 passengers not 4 as my daughter is an infant, then they backtracked. Then she said it will be vouchers not cash, I told her we wanted cash so she has taken my account details and said she will sort that, so I'm quite happy.


    The only thing now is the rate, if they pay at 1.35 it will be £1185, if they pay at 1.25 it will be £1280...almost £100.00 difference. I'm sure I've read it should be paid out at the rate of the time of delay and not the decision date as they are telling me. Just need some evidence to back it up.


    Saying all that, do you think I should just take the €1600 at a rate of 1.35 book a new holiday and get on with my life?


    Certainly won't be going to court.

    can I ask when you put your claim in, how long it took them to get back to you? ive waited patenitly for 4 months now, now im getting miffed. i was delayed 7 hrs out and over 3 hrs back from mexico in 2012.. did you just use the claim form on the thomascook website, or did you use tips from Vaughns guide ?

    I put my claim in on 19/12/2014 through the TC website and I also sent them a letter through the post by using a template from the MSE website, had a reply back on 24/12/2014 saying that they had received it.


    27/01/2015 received a mail saying that our claim was eligible for compensation, we will receive within 28 days. I've just chased up today to get the amount confirmed, good job I did as they were going to do it for €400 less than what it should be and I have arranged for cash rather than vouchers.


    All in all I'm quite happy with the process but then I'm doing this for a recent claim, not one that is a year or 2 old, that may be your problem.


    What I have learnt is that they do not respond e-mails, that's why I called today and I got straight through, the number I called was 08434 550117

    I would be careful about dialling an 0843 number especially from a mobile, check with your provider for costs, because 0843 are not included in your free minutes or call packages

  • Good Evening Everyone,

    In my last post the Judge had given TC a final 28 days to enter a valid reason for defending in writing to both myself and the Court. As he stated he could see no reason for defending the case further.

    Well Thomas Cook's time came and went. After the 28 days I contacted the Case Manager who had not received any correspondence either.

    I emailed the Court asking for a Judgement stating in bullet points the previous Court Orders that they had failed to repond to. And obviously how wholly unreasonable they have been over the last 2 years.

    That was ten days ago and I have not heard a peep back from the Court. Do any of you fine people know how long a Judgement can take and what my next move is should they rule in my favour?

    I have scoured the threads and my case seems quite odd compared to others, maybe Weightmanns have lost my details or something...
