    I believe I would be in a strong position in proving I was on the flight as I have the provided them with the flight number, date and the delayed departure time from the flightstats website. I also have a copy of my credit card statement making the payment to them and a note in the database of the hotel documenting my delayed arrival.
    The problem is they will not even examine my claim without their documentation.
    I have considered applying a subject access request to them but it seems ludicrous to apply to them to give me information, which I have been told by them they hold, so that I can give it back to them

    I think you are totally misunderstanding me! It is up to TC to PROVE you weren't on the flight. Oviousley, they have ALL your details so would be impossible for anyone to pretend they were on a flight that they weren't. Jeez!

    Stooklie, I never had any documentation or booking reference number, old emails etc. I had to look at our passports to even find the date of the flight in question from Turkey to Manchester in July 2009. The only details I gave them were the date and flight number and number of hours delayed which I retrieved from Flightstats site.

    You keep jumping through their hoops and they will keep setting them up for you!

    Which flight have they compensated you for?

    They have compensated me for the 2010 holiday and after phoning them this morning they have confirmed that they will be sending me the cash equivalent and I will have it within 28 days.

    Thanks everybody for the comments which have been helpful. I now think it is the time for an answer or move to court action. Will post any update which I think would be of interest.

    your passport has a barcode strip on it it, your travel can be traced easily when you go through customs its scanned every time

    They appear to be stalling at every chance !
    Give them 14 days then straight to court ,i filled in my court application thur just waiting now !

    Had a letter off TC this morning enclosing their defence to the court,, letter states they will be paying for my inbound flight which had already been agreed and their reply to the outbound one, which I have been waiting to know the cause of is:

    'with regard to the outbound flight, the Defendant is unable to admit nor deny the Claimants claim for compensation as its enquiries in this respect are still ongoing'

    How is this a defence?? Are they just allowed to continue with no reason indefinetly?? Will this incur court costs now??
