• Hi all, I'm a little stumped as to who I need to initially write to. Here's my scenario......

Package holiday booked via Thomas Cook in 2007, Bristol to Dalaman. We had a 10 hour+ delay. The flight out was with First Choice, who I believe merged shortly after with Thomson. Who do I need to write to first to get the ball rolling?

As I received the following email on 7th Feb,, just after issuing my MCOL papers, do I now need to wait for the court case to get this money as they are defending both flights,, the total requested. They ignored my mail asking them to send a cheque for the flight not in dispute.

With regards to the delays experienced, we have received confirmation from Thomas Cook Airlines that the delay to your inbound flight does qualify for compensation under current regulations. I can therefore issue you a Thomas Cook Discount voucher to the value of £1079 but need your home address confirming to send this to you.

Unfortunately, the circumstances surrounding the delay to your outbound flight are still under investigation with the airline and as soon as we receive their decision, we will immediately update you.

You are almost out of time to claim - end of the month. You need to write to the airline (now merged with Thomas Cook I think?) and give the 14 days to respond. If you don't do this, and then start court proceedings before the 30th, you won't be able to take this further.
Thanks for advice

I wrote last night using the template. Today I went on the Thomas Cook website and logged the complaint there as well.
I got an automated reply from customerer.relations@tccustomerrelations.zendesk.com>
At least now I have proof they have recieved my complaint. I am trying to get legal help from my house insurance. I may go ahead anyway and start small claim proceedings in two weeks.

Hi. My case is similar, a MyTravel flight back in 2007. Thomas Cook originally denied my claim as they said Mytravel was an independent airline and not part of Thomas Cook. They did infact merge months before my flight, the merger was 19th June 2007. That may mean you face difficulties claiming with Thomas Cook as your flight was before this date. Only want to advise what i have come across from my own case but hopefully you can pursue it still. As the claim is with the airline, perhaps TC take over the liability after merging. Be interested to hear how it goes

Have sent letter to TC. Will keep you posted
• I recently decided to complain to Thomas Cook with regard to 2 flight delays, both from Dalaman Airport returning to Manchester.

Flight TCX975L had a scheduled departure of 02.05 on 1st November 2010 and actually departed on two separate flights, mine at 17.30 on the 1st November 2010.
Flight TCX2869 had a scheduled departure of 01.55 on 15th June 2012 and departed at approximately 20.30 on 15th June 2012.

I sent two separate complaints recorded delivery at the beginning of February. On 1st March I received the bog standard letter stating the delay was "unforeseen" and I was not entitled to anything. I replied by e-mail on Tuesday 5th March asking why I had only one response when I had sent two letters. I received a response last night explaining that my other letter was on its way.
Today I received a letter with a voucher for £1080. I will be requesting the cash equivalent.
Both delays were of a similar length and I don't understand why they have paid up for one and not the other. I will be pursuing, but £1080 was a nice surprise today!

Have received a notice of change of solicitor from Thomas Cook
I sent them an email before filing my N149 pointing out that I had a letter from AESA (Spanish NEB) saying that TC had failed to prove EC and thus should shell out the compensation.
TC are standing behind their defence and say "ultimately it will be for the judge to decide whether or not the circumstances surrounding the delay were extraordinary" So they want to ignore the findings of the specialist NEB and put it all in the hands of a judge who will have little specialist knowledge in the case!

I think the judges will be up to speed ;)

But certainly print off all relevant pages from the rulings and include them in your court 'bundle'.

Just logged back on to MCOL and they issued a defence today,, when do I find out what their defence is as they have already admitted one flight meets the requirements of the claim but won't tell me what the cause of the other delay was.

How frustrating :undecided

The court will forward to you the paperwork defence filed, they are also bound to send you a copy.

One thing is for sure. Filing a MCOL *forces* the airlines to do something, rather than keep fobbing off.
I wonder how long it will be before they send a judge a "it's like a car breaking down" excuse by mistake :rotfl:

Oh right so they never need to tell me what caused the delay as I have been asking for 2 years with no response! Surely as they have left me no option other than to take them to court as I was never told the cause this should be in my favour when it does go to court?

Why not just tell me the reason if they are prepared to go to court with it?? I may not have taken court action if they had??
Don't understand TC's reasoning.
Don't understand them either, refused to tell me the reason for our delay for "operational reasons", thought I was dealing with MI5 not TC. They did actually write ant tell me the reason 7 days after I had filed, just more ammunition to throw at them.
