    in filling my court form to proceed with action it asks Does, or will, your claim include any issues under the Human Rights Act 1998?
    Yes or no ?

    Plus for court action Bradford address or Peterborough ?

    I've now gone past the second letter deadline stage stating the 14 days before court action and I now want to start the court action or should I wait on the CCA response first, as I wrote to them on the 3rd February which they confirmed they received.

    Also, if I start court action now, my claim is for a party of 13 paying passengers at €7800 and the limit at the moment is £5000 although it looks like to be increasing in April to £10,000 as advised on MSE. Should I wait until April or ask TC if they happy for me to put one claim in and if not shall I tell them that we will put six claims in through the courts, one for each couple. Most of the party are elderly and some disabled so I would rather do the work for them.

    Apologies if there are obvious answers to this but it’s just getting my head around the best way forward.

    I have been on here asking questions before, and am grateful for the answers so far.

    We flew to Cuba with Thomas Cook in August 2012, basically our arrival in Cuba was delayed by 26 hours.

    We wrote to Thomas Cook in November making a claim and had an acknowledgement.

    We then chased in January and they said the review of our case was taking longer than anticipated.

    We have heard nothing since. Are they simply trying to get out of paying due to their current troubles? Is there anything I can do to expedite this, should I contact the CAA or something?

    I cannot believe this should take them so long - they should have the details of the flight(s!) involved and it is quite clearly their problem.

    It involved the first flight turning back home and the pilot stated that he had argued to fly to Cuba but had been ordered by ops to turn around.

    Any advice would be much appreciated. Thank you.

  • Well I emailed TC again this afternoon and said if I didn't get a response with 14 days I was going to the CAA and would take court action. They replied within about 5 minutes, with yet again the same cut and paste response.

    Hi. My case is similar, a MyTravel flight back in 2007. Thomas Cook originally denied my claim as they said Mytravel was an independent airline and not part of Thomas Cook. They did infact merge months before my flight, the merger was 19th June 2007. That may mean you face difficulties claiming with Thomas Cook as your flight was before this date. Only want to advise what i have come across from my own case but hopefully you can pursue it still. As the claim is with the airline, perhaps TC take over the liability after merging. Be interested to hear how it goes

    I know it's a bit of a pain but there are other posters on here that are on the turned around plane that are claiming if you can get together and swop notes.
    It was clearly a commercial decision to turn around, not a safety issue, so compensation is due. A commercial decision, as it's cheaper and easier to fix the plane in the UK and not Cuba where gaffer tape is the only stock item for repairs. :D

    TC issued an Acknowledgement of service on 18th February therefore the date for the defence would be 5th March.. There is no change to the status of my claim on MCOL,, should I be doing something,, there is nothing on the MCOL site to say.

    Well technically you can now apply for judgement by default, but others who have also gone MCOL have found a defence filed 2 days late and been accepted by the courts, so another day to wait I assume.
