    I've contacted Thomas Cook about claiming compensation for our flight to Manchester from Turkey, which was six and a half hours late.
    They have said the delay was due to to a yaw damper fault, which raised concerns about the aircraft’s safety. I can confirm however that this fault has not happened to the aircraft previously and therefore this could not have been foreseen.
    Am I entitled to compensation in this case?

    I doubt that would class as exceptional circumstances!
  • Just had an e-mail from TC offering vouchers for delayed flight in line with their obligations under Regulation 261. Have followed up with request for a cheque as have already booked this year's holiday.
  • would anyone know the distance from glasgow to dalaman as unsure how much compensation to request on my claim, this was a 12 hour delay in oct 2009 was told technical difficulties at the time so worth a try!
  • Sorry I've never used before so I hope I am doing this right!

    I have tried to make a claim to Thomas Cook for a Dalaman to Manchester flight back in 2009, delayed for just under 8 hours.

    First they replied to me saying:

    I note your request for confirmation of the reason as to why your flight was delayed. I can confirm that your flight was delayed due to a technical fault due to a problem with the aircrafts spoiler.

    Then when I pushed them for more information as as far as I am aware that they can not use this excuse, they replied:

    Unfortunately we are not able to provide you with the answers to the questions raised in your correspondence detailing the cause of the breakdown, as this is a private matter to be addressed by Thomas Cook
    The cause of the breakdown could not have been foreseen prior to your aircraft departing and for that reason, we class this flight delay as and an extraordinary circumstance’ and no compensation would be applicable.
    We, as Thomas Cook, stand by our decision and should you wish to pursue this matter further, I would therefore suggest that this is done through more formal channels.

    Do you think I have grounds to push further or not?

    Before i go to court i asked TC for a reason for the delay in writing
    here is the response i got today

    Dear Mr W,

    I write further to your recent correspondence and I am sorry that you remain unhappy with the response you have received so far from our Customer Relations Team.

    Unfortunately we are not able to provide you with the answers to the questions raised in your correspondence detailing the cause of the breakdown, as this is a private matter to be addressed by Thomas Cook

    The cause of the breakdown could not have been foreseen prior to your aircraft departing and for that reason, we class this flight delay as and an extraordinary circumstance’ and no compensation would be applicable.

    We, as Thomas Cook, stand by our decision and should you wish to pursue this matter further, I would therefore suggest that this is done through more formal channels.

    I thank you once again for taking the time to contact Customer Relations and whilst I appreciate your disappointment at present, I hope that Thomas Cook may be of assistance to you in the future.

    So are you going to take it to court, as from the response I have no idea what to do!

    Yes i am convinced i have a very strong case and will be doing it tomorrow i have set the afternoon aside to filll in the online forms

  • On 30th March 2007 three of us were booked on Mytravel flight MYT51 from Gatwick to Salvador (Brazil).
    The flight was delayed by nearly 12 hours during which time we were given a room at an airport hotel.
    I have a letter from Mytravel putting the delay down to “late release from scheduled maintenance”.
    I have the flight coupons which have a Thomas Cook logo on them. It was booked through First Choice Travel.
    Who should I approach? Am I going to have time to make a claim for this before the 6 year time limit?
    Would I be better going to an agent to recover the money because of the lack of time? Any advice welcome
