Hi,
My claim was turned down last year (21 Nov 2013) by Thomas Cook with the usual 'extrordinary circumstances' plea. I opened the case at the end of August 2013.
I was travelling back from Tenerife to London Gatwick, on 6th September 2008 with my partner & 2 children. We were delayed for 5 + hours.
this was their excuse:
Having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature. These were extraordinary, in that Thomas Cook took all reasonable precautions necessary to avoid the situation, and despite our proactive measures the problem could not have been prevented. All our aircraft are maintained to a very high standard, in line with CAA regulations, however, despite these steps, mechanical failures can arise without prior warning. These unpredictable events can be likened to those we encounter with our own cars, despite having full service histories, or MOT’s.
In line with Regulation 261/2004 a payment of compensation would not be considered applicable in this case.'
Travelling with 2 children (and having broken my foot!), it was a pretty uncomfortable situation!!
Can I re-open the case do you think, in light of the recent developments? If so, how would I proceed next?

you needed to have commenced court proceedings within 6 years of the flight (even if the case was stayed awaiting the appeal outcome)
If you did not start the process, you are too late now so I would fully expect the airline to reject the claim or ignore you0 -
Thomas Cook have now paid our flight delay compensation, We were delayed by 6 hours on a flight to Turkey in 2012, however we only claimed earlier this year. After initially getting offered a voucher and then given the runaround, I got p****d off and rang customer services, spoke to a few people, and £1256 was paid into my bank account by BACS transfer. So, keep pestering, they will eventually get fed up and pay to get you off their back.:)0

I didn't, because they said I wasn't entitled to claim
So there is nothing I can do then, but let it go?0 -

Hi all, glad to see some successful compensation claims.
I have done a forum Search on Flight Number TCX297K but cannot find anything? Read the guidance on Claims and been to try and find this flight but it does not exist on the day that we travelled? We were booked on this flight from Manchester to Toulouse on 21st Feb 2010 and it was delayed for 12 hours? From recollection i think we had to wait for a Toulouse returning flight before we could depart? I have no clue what that flight number was - any advice or should i just contact Thomas Cook?0 -
The flight is there on flight stats - but there's no info on actual timings. But it's irrelevant for your claim. Have a read of my guide, if you've not yet done so.0

Anyone else had a letter from Converge Claims Management regarding paying compensation? I can't find any mention of them on here...0

Appears rep had taken their names off the Glasgow flight but forgot to book them on the Manchester one?
Any advice would be great.

i have just received a email from thomas cook asking for some documents which i dont have
the flight was over 4 years ago so i never thought to keep anything
so what do i do now0
