I have attempted to previously claim against TC for compensation for a delayed flight in January 2009 (19/20th) to Montego Bay. The problem I have is that I don't have any paperwork rebgarding this and nor do I know the flight number. I do know that the plane went from MAN to LGW then to Montego Bay. TC say they have no record of us and so they will not pay out. Basically flight got diverted to Glasgow as girl on ghe plane was bleeding (miscarriage) which she had known about and had informed attendants at MAN where she was refused but managed to board at LGW. We wefre just told it was medical issue and I guess she became mofre concerned mid flight so plane was diverted to Glasgow and then we were told we had missed landing window and so had to stay overnight in Glsgow and fly out the following day. So were delayed 24hrs. Long shot I know but anyone think of anything I can do or any way I can find out flight number or anything to confirm we were on the flight? Thanks in advance for any help I appreciate its a massive long shot. Not sure if its relavant but I did book thru Direct Holidays but flew TC.

An in flight medical emergency with a passenger sounds like extraordinary circumstances. Even if you could identify the specific flight, I think you would struggle to make a successful claim. On the other hand, the airline has to show it did everything possible to minimize your delay - and I wonder if their defence would fail on this point? Tricky though, I fear.0

I thought I would chip in. Our flight back from Corfu to Bristol in June was delayed for over 6 hours (and as a result my business could not open on the weekend, so I lost revenue). The flight apparently had a technical issue with the door.
I used the MoneySavingExpert step by step instructions to lodge a complaint with Thomas Cook, and they told me that it would be put on hold until after Jet2 was heard in court.
Following the Jet2 result, I emailed them again and asked them to process my claim. The email that followed from them was this:
"
Thank you for contacting us again about your flight delay and for providing us with further details.
I’m sorry that your flight with us was delayed and based on your comments we conducted a full investigation when you wrote to us initially. Following a review of our maintenance data and an analysis of our other operations at that time we remain confident in our decision that compensation is not payable in this case.
The Civil Aviation Authority (CAA) are the registered National Enforcement Body for Regulation 261, and we operate within the guidelines they have issued. If you remain unhappy, we can suggest you contact them about your flight delay by visiting CAA
I am very sorry that we were unable to resolve this for you and I do hope we will have an opportunity to restore your faith in the future.

At this point I googled 'no win no fee flight delay" and have applied to bottonline and await their response. They take 27% of any win - but I don't have the time to persue this myself, or the nouce, so I will see what happens, and will update you all when I hear.

I wrote to my court last week Friday on the day the ruling was made to lift the stay that was put on my case regarding the outcome of huzar. Just awaiting the decision now. Will it still go ahead with a hearing or can the judge order that TC pay out without going to court? Thanks0

Same with me, replied to the court to have stay lifted and to reinforce the fact of interest was claimed as well. The court may decide that the defence cannot win and judge in your favour, the CPR's allow for this.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)

Hey everyone
Just wondering what my chances are here.
Me and my partner were delayed on 08/07/2009 for roughly 10 hours with thomas cook.
We were off to turkey Bodrum from Manchester and the only information I have is the visa stamp that we gained on arrival on the 09/07/2009.
I remember we went and sat on the plane for a couple of hours waiting for a pilot to turn up because they was an issue with the pilot that was originally organised. The stand in pilot then seemingly just didnt show up and we was escorted of the plane to spend a few hours in a hotel, fortunately for me and my partner this was the hilton. We were given documents etc but at the time the insurance was roughly £20-£50 for a delay so i never bothered.
I appreciate I dont stand much ground with just a passport visa stamp but surely thomas cook would have to prove that there flight on this date was not delayed and that we was not passengers?
Any advice is greatly appreciated and I apologise if this has been asked I have gone through numerous of threads but there is so many.

Perhaps. But I'm no more interested in CAA guidance than I am in the contents of my handkerchief: it's UK law, not CAA fantasy, that really matters.
The CAA should stand up & take responsibility for this mess. We need an ombudsman. There's no one looking after the customer here
