This is now ENTIRELY within your control. Give the airline 14 days to settle and on day 15 start a court action. For delays involving technical faults, the airlines no longer have any defence. So go get them!
Vauban, is the NBA up to date on your advice bit?? I mean does it mention the courts latest decision or even need to??.

Yes - if you read it, you'll see it specifically references the recent Supreme Court decision.

Niiice!! This is what I wanted to hear (I posted a question/ new thread prior to seeing this)

I'll sendmy first claim / template letter away, then should no compensation be forthcoming, ill begin court action.

    GGGrrrrr ;)
  • Which method are everyone using to claim against T.Crook?

    By email or by post?

In my past attempts at claiming ive posted letters to :
    Customer relations, Godwin street.....
  • Hi,
we experienced a delay of over six hours on the above flight from Manchester, and I did send off a letter in May 2013, to be told it was a "technical problem" and basically no chance of compensation. I wasn't really inclined to pursue it any further after their refusal, and I also suffered a family bereavement at that time, so just forgot about it until the headlines in yesterday's papers. I'm inclined to give it another go, but unfortunately I appear to have thrown away the letter from TC and deleted any original emails referring to the flight details, so now I don't know what the flight number was or what the exact scheduled times were. Can anybody advise me where to find those details now ?
    Thanks very much
    :)

EDIT: The flight is TCX 2474, which should have departed at 7am but left at a quarter to two in the afternoon.
  • Thank you, much appreciated.

Quick background - delayed on flight TCX5245 from Corfu to East Midlands 26 August 2013 (5 and a half hour delay), two groups travelled under seperate bookings.

I made my claim and was originally told no as TC said the delay was caused my "technical problems". I ended up using the legal protection on my house insurance and finally received the "damages" from my solicitor on Monday.

The other group then sent their compensation claim letter to TC.

They got a reply from TC yesterday stating that compensation is not payable as the delay was caused by "Industrial Action".

They have sent a reply asking why their claim has been turned down when TC have already paid out on my claim for the exact same flight (they have enclosed details of my booking on the reply).

Any advice on how to proceed if TC still refuse to pay up?

Just to let you know TC agreed on Thursday to pay out for the other group of 6 passengers that travelled with us on the delayed flight.

It is annoying that they lied to us again when we put the second compensation claim in but as soon as a solicitor got involved they paid out.
    Cashback earned
    Quidco : £858 :)
    Pigsback : £20 and a Beatles CD.

Thanks for your response - so if I read it correctly the fact that we were taken to Manchester and couldn't be flown out in a reasonable amount of time should help our case?

I'd also like to know how many times hydraulics have been used - it sure would help in arguing that it's not EC if it's happened lots of times...

We were on Flight TCX7019 from Lanzarote to Cardiff on 12/06/2013 and had a 5 hour delay - claim initially refused due to "green system hydraulic leak that needed a replacement part- we are still pursuing our claim ad wonder if anyone else was on that flight from the forum
