Safest bet is to wait out Huzar. To be honest I don't see how the judge will do anything other than stay.0 -
Not got the exact wording on me, but something to do with the wear of the rotor blades on the engine. They say the took the engine off another plane a couple of weeks before the event and that it was unforeseen, they have an email from Rolls Royce which states that the problem has never happened before in the Trent 700 project and then try to baffle me with graphs.
They then have a witness statement from people within TC saying that the incident is not inherent in the running of an aircraft.
Please tell me, how many aircraft can fly without an engine!
Irrespective it is wear and tear simples, the RR email is just hogwash as what they are saying that in all the testing and the aircraft has been flying years that its a manufacturing defect! anyway heres something for you.
1. Download the AAIB report into the manchester TC flight that had an engine blow on take off in june last year, in that it describes cycle fatigue as the cause as your argument, wear on engine.
2. Go onto Aviation herald and search for problems of the same as your and you will be suprised that this happens every other day, at least 50-60 every year so its not extraordinary.
And never mind the graphs, simple matter is the engine broke and that is part of day to day activites of running an airline, just as a car would. Unless this was cause by a third party then stand your ground as the regulations state and the law as it stands, tech issues are not extraordinary unless cause by a third party.
All in all as state above by the good chaps, it all could be irrelavent anyway, so take the stay as no doubt it will happen and wait with the many thousands of us.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)

Thanks for your advice Batman (and earlier Vauban). I think it might be too late to submit the AAIB due to it being less than 14 days now, etc.

Sorry i forgot it was the infamous G-OMYT, you have a clear and dry case on that especially with the damming AAIB report, yes you can submit the evidence even at this late stage, maybe the chaps on here can explain how but i know you can.
Like I said i think they will get you in court just to stay the case, or pay up because of the aircraft involved.
I have a letter from the court pending outcome of the appeals to refer back to the court for a definative court decision.

No, you can only claim interest if it goes to court and that is at the judges pleasure. So if offered settlement before court take it with your costs.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)
