    It's true that interest is at the judge's discretion, but given it is a significant sum involved - and that the airline are now certain to lose - it is not unreasonable to say that you want the interest as well. This would involve you going to court, and there are no guarantees that you'll get it. But as the airline have held out paying for over two years, there should be a cost to this behaviour. I'd hold firm if I were you and only agree to settle on these terms: after all, it will cost the airline more in solicitors fees that to pay you the interest!

    Would it go against me in court if they had offered me the full settlement minus interest and I had turned it down?

    Having said that - its the law now anyway so there is nothing to go against me!!!!

    I personally don't think it is unreasonable to ask to be compensated for the delay in paying up, especially as the Supreme Court has ruled that the law is (and was) clear. And the sums of money are significant - so it is hardly vexatious.

    Looks like you might be one of the first post-Huzar cases. How exciting!

  • Yay, good news. Have been in touch with Travelaw and informed the Court. We wait to see....... will report back.
  • Hi all, after 14 months and lots of emails I've had a response from thomas cook, they are paying out compensation no arguing!!!! Brilliant news.
    Contacted the Greek aviation authority and they come back with nothing but did say thomas cook had broken regulations, said I would have to go to court. Was building myself up to taking the court route when an email from thomas cook arrived stating we would be compensated the full amount for each traveller. Made up with this I will wait for the cheque in the post

    The flight was TCX3019 from Heraklion Crete to Glasgow on 3rd September 2013, so anyone else on that flight contact the Greek authorities like I did.

  • Well, it seems some Thomas Cook claims are not coming out of delay while they look into the Supreme Court decision and what ramifications it has for the company. In particular the "mechanical fault" claims.

    This is now ENTIRELY within your control. Give the airline 14 days to settle and on day 15 start a court action. For delays involving technical faults, the airlines no longer have any defence. So go get them!
