    - So?
    - No

The point I was making for point 4 was that they did not reply to my complaint so does it still count as ongoing?

Also, I read in the FAQ's that you could complain up to 8 years later, Is that not true?

you asked if sending a letter of complaint counts as ongoing. The answer is NO as the 6 year deadline applies to getting your case into the court system (even if the case is not actually heard until after the deadline) If you have not submitted to the court within the 6 years you are too late

This is a EU regulation and it does say you can claim for flight back to Feb 2005
If the airline rejects your claim your final step is to take them to court. The court deadline varies by country. In Scotland this is 5 years from the date of the flight, in England and Wales this is 6 years from the date of the flight. There may well be countries within the EU that have a longer date but you are unlikely to be able to raise your case there

In short, unless you had your paperwork into the court within 6 years of your flight you are too late. This is all covered in the "Please check before posting" sticky at the top of the board
  • We are just back from a week in Fuerteventura. Holiday was great but flights were a nightmare.
    OUTBOUND - MAN>FUE - Condor DE3482 15 Oct
    INBOUND - FUE>MAN - Condor DE3483 22 Oct

The outbound flight was delayed over 2 hours (pilot said something about safety lights at the exits not working) ... not to mention the majority of the plane toilets not working either !
The inbound flight left over 3 hours late but it was obvious from the rushed boarding and very fast return flight (including slamming the plane down on Manchester tarmac) that it was a race against the clock. I think it managed to arrive 2hr 45min late.

I know both these flights are under the 3hrs landing delay, but there's obviously some problem with these condor flights. A look on flightradar24 shows that they have only been on time TWICE on the last TWENTY flights !! They don't seem to care as long as they beat the 3 hours. We spent an extra 5 hrs in the two airports altogether!

As I said, we had a great holiday, but the late flight arrival meant we missed our paid dinner on the first night and the late flight home meant our friend (who was working the next day) came to pick us up after 2am.

Is it worth contacting Condor as both flights were under 3 hours? They said the return flight was due to their earlier flight being delayed ?? which seemed kind of obvious! It was a full European crew but their English was not easy to make out. I'm sure there's a couple of hundred passengers out there who were also on the 2 delayed flights and they'll remember the crazy inflight announcements haha!

Is my best option just to go to Thomas Cook direct, noting the missed meals and return time inconvenience to see what they offer as I guess that'll just be a token gesture?

    Thanks in advance
