  • Well the absolute farce continues.

    Today I called Manchester courts to see where my case v Thomas Cook was. The lass at the court was great, and informed me that ALL flight claim cases had been stayed until the Supreme Court had heard the latest appeal case from all the airlines.

    Do any of the legal eagles know if this is actually right, and if it is, how on earth will this ever be resolved? The airlines are taking the p155.

    It's right got my notice this morning all cases are being stayed, nobody wants to stick their neck out on this. Now it's a waiting game again. No decision has been made yet as to the appeal being allowed in the SC, we could find out before recess but don't bet on it. I know that they way the order has been worded is that it will be a final appeal attempt, the judge's are getting annoyed by it all if you read between the lines. "Further and consequential directions"
    I hope they will throw out the defence's without hearings if they lose and judge in favour of claimants.

    Don't really as none given. However? I was told at the airport it was a knock on effect from previous flights being delayed.

    Your dates don't match up with your flight number, at least according to flightstats. Double check. But if other flights were servicing Egypt to Manchester at the same time, you can rule out weather or strikes. Was there a medical emergency on your flight? If not, I don't see how they ave a case.

    That is a copy of the email/letter reply I received back from TC which in my eyes suggests standard reply.

    Problem is my flight number changed from original booking. I did know the new flight number before travelling by a couple of weeks. don't know why its not on flightstats. but, that's the sort of luck I have. There was a flight by Thomson at the same time. There was no emergency on my flight as we were delayed at the airport. I was told that it was a knock on effect from a series of delays from the previous day/days

    By elsewhere I mean the CAA.

    In Thomas Cooks defence it says. The defendant is incorrectly named as Thomas Cook Tour Operations Limited. The correct defendant is Thomas Cook Airlines Limited. All further references to the defendants should be construed as meaning Thomas Cook Airline Limited.

    It goes on with reference to the EC Regulation 261/2004.

    It says. The Defendant admits the Claimant’s was delayed due to operational reasons, and as such is entitled to compensation. It goes on to say how much the compensation will be.

    Now the claim as been sent to the County Court Hearing Centre. So now I’m awaiting Judge’s direction.

    Can the claim be thrown because the Defendant decided to change their name.

    The Defendant didn't change their name; you sued the wrong company! Only the airline that transported you is liable under Regulation 261/04, not the travel agent.

    You may have to pay a fee to amend the defendant - perhaps wait for the direction from the court?
  • Thanks, but all the corresponded was with Thomas Cook Tour Operations Limited until they submitted their defence and I bought the flight ticket with them. Can the fee be claimed back?
