  • Hi
Im trying to establish if I am able to claim back any compensation due to my flight being delayed.
Me and my Girlfriend were on our return flight from Tenerife south airport to London Gatwick.
The flight was scheduled to leave Tenerife on 3rd June 2014 at 16:25 but was delayed for 3 hours not leaving until around 19:25.
The flight was scheduled to land at 20:40 but instead landed 23:12 under 3 hours delay in the landing time.
During the delay there was no information given to us by any persons working for thomas cook. We were told that the flight was delayed due to a technical issue, given a £6 euro voucher each to use on food or drink in the airport and had to wait until gone 8pm to be given our gate details.
If someone could help me, letting me know if I have a claim and if so how to complete it, it would be greatly appreciated.
    Thankyou
    Jamie

Under 3 hours delay upon arrival so no compensation due.

Yeah I've already read the FAQ's, I have a friend at a Solicitors who deals with their accident comp. claims and he advised just to hang fire until the Jet2 Appeal Court Case so I haven't even approached TC yet but as it is thought Jet2 will Appeal he advised I write to TC but just wondered if anybody else had claimed. I've been told somebody on the flight got £1000 plus a free flight so I didn't want to send the stock letter asking for 600euro if they are paying out more.

Yeah. Apparently they're giving away fridge freezers and a free mini cooper too. Make sure you ask for that as well ...

Thanks. I have actually spoken to the person but after reading up over the last few weeks I am wondering if the payout referred to has been exaggerated! That's why I thought I would ask if anybody else has received payouts.

I think that must be right. People are doing well if they get what's owed to them!

I think it's disgustng people getting more than they are entitled to; I'm going to ask the CAA to take action against these airlines. That'll show them.

  • I and my wife were subject to a delay from Manchester Airport on 1 June 2014 and I contacted Thomas Cook requesting compensation.

I have just received this reply:

'Thank you for contacting us about your flight.

I am sorry that your flight with us was delayed and for any inconvenience that this must have caused you. We work really hard to ensure that when a flight is delayed the disruption caused is kept to an absolute minimum.

There are a number of factors that can contribute to a delay that have to be considered, such as Airport Authorities or Air Traffic Control, before an up to date departure time can be secured. As soon as confirmed information becomes available we commit to telling our customers at the airport or in resort.

A full investigation has been carried out to find out what the cause of the delay was and under EU Regulation 261/2004 compensation is payable on this occasion.

I have arranged for a voucher to the value of £652.00 to be sent to you to use on your next holiday. This equates to €400 per person as outlined in the regulation. This payment is in full and final settlement for everyone on your booking.

The on-time performance of your flight is as important to us as it is to you, thank you for contacting us and we look forward to welcoming you to travel with us again soon.'

I would prefer not to have to book another holiday within the Thomas Cook Group . Can I request that the compensation is not provided to me as a voucher but as a cheque or bank transfer?

You do not have to take the vouchers - you can ask for cash.
  • Thanks Vauban, I'll 'ask for the cash' and see what happens!
