I have been seeking compensation from Thomas Cook flight delay on 12/7/13 from Sanford to Glasgow. The CAA have ruled that Thomas Cook's response of 'extraordinary circumstances' is not valid and have asked them to pay compensation. TC have stated that they are defending their claim and are refusing to pay compensation and the CAA decision means nothing.. Any advice as to where I should go from here?
There was also a Sanford to Manchester flight delayed similar to us on that date and I am sure the same excuses will have been presented to any Manchester passenger trying to claim.0 -

The FAQs on page one have a "What to Do Next" link - but essentially it is court - either through a NWNF firm or yourself.0 -

I am just about to start looking into a small claims court case against TC. They have paid compensation to people on the return leg of my delayed flight but are refusing to pay me for the outbound on the same reason for delay!!!!0 -

Thinking of putting in a SAR to TC for information on what compensation has been paid on 2 particular flights. I know one claim was paid on the return leg of my delayed flight for the same reasons but TC still wont pay me!
Is this request a valid one or have I got the wrong idea about what can be accessed under a SAR?
The flights concerned are TCX 7028 23/3/2013 Bristol to Fuerteventura and TCX 7029 23/3/2013 Fuerteventura to Bristol.

A Subject Access Request is made in respect of personal data/information held by the airline on or about the applicant. So it wouldn't help to answer your question. (A Freedom of Information request might have, except that the act doesn't apply to private companies! )0 -

Re tcx 1469 grenoble to gatwick 25th jan 2014 - have also treid to claim compensation. TC reply " Having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature. These were extraordinary, in that Thomas Cook took all reasonable precautions necessary to avoid the situation, and despite our proactive measures the problem could not have been prevented. All our aircraft are maintained to a very high standard, in line with CAA regulations, however, despite these steps, mechanical failures can arise without prior warning. These unpredictable events can be likened to those we encounter with our own cars, despite having full service histories, or MOT’s." hence no compensation etc
Have just watched Dont get done get Dom on the BBc Recent episode on This topic - tech issues etc not always reason not to get comp. Am planning to ask what tech diffs were; when and where they occurred? Why they were unable to make adjustments etc. Have you had any further luck?0
