  • Thanks again, you've read their website and t and c's exactly how OH and myself have read it ....... yes they are asking for £80 upfront before they go any further .....

    3.7 covers themselves doesnt it? but doesnt make it clear, i totally agree with you its inconsistent but i'm sure it "covers their backs" in cases such as mine ...

    They are claiming £1020 on my behalf (3 of us) minus their charges would be £770 back to us, so i suppose we've got to decide whether gambling and paying the £80 is worth it ........ there's us thinking taking it to a NWNF would be the easier option.

    We do think we have a good case against TC, so do Blueway (but they would say that to get the £80 or would they not bother incurring their own costs?) The TC plane had two different technical problems with the plane, they corrected the first one, we taxi'ed out to the runway, then found another, but my only issue is that we were boarded on the plane the whole time, so a 4'ish hour flight from Dalaman to LGW, we were actually on the plane over 8.5 hours (the first 4 with no air con or drinks, it was unpleasant to say the least) ..... so dont know if TC have more of a case because we were on board? Flight stats do confirm that we were over 4 hours landing though so Blueway agreed from outset we "should" be entitled.
  • Hi there just wondering if anyone was on the flight coming back from Alanya going to Newcastle on the 5th August 2013.

    Due to being delayed for 5 hours 10 minutes I'm curious if someone has claimed compensation and has been successful?

    The Airline is refusing to pay out however, the CAA say that we are entitled to compensation, I am just wondering if anyone else has been successful or is still trying to claim?

    If you have a positive letter from the CAA you should start legal action: it doesn't matter if someone else has won (it sets no precedent) but your chances are good. So go for it (take a look at the "Taking the Airlines to Court" thread).
  • I was delayed for 11 hours last year and have challanged with Thomas Cook who would not pay any compensation. I went to the CAA and they have came back and said they should have paid us compensation in their view. I sent it all on to Thomas Cook who are still refusing to pay out and advise I take legal action, I really do not want to do this, can anyone suggest any other way I could get them to compensate us? any help would be greatly appreciated. we were travelling to tenerife for my dads 70th birthday and we lost the whole first day of our holiday. all they gave us was a £4 voucher each!

    Machine gun or hand grenade? Only way is court action and if you don't fancy the prospect I'm afraid it is a no win no fee for around 73% of your entitlement.

    Good news this morning via email - Blueway have agreed to pay our £80 up front court fees, they say 3.7 in the t & c's is where it says a court fee is payable up front.

    I have been constantly chasing them since December and explained to them i never get an update unless i ask and takes a couple of emails to get a response, so pleased they have agreed to pay these fees ...... now onto the next step ....... court !

    9 of us took a flight to punta Cana ( Dominican rep) MY013 scheduled to leave gat wick around 12pm on 22/10/2007 . I understood I could claim back to 2005 so thought 2007 would be okay . The flight left 0209 on 23/10/2007,so 14 hrs delay . Thomas Cook took over my travel between June 2007and completed 2008, so that's why I looked to them for compensation. I have just had an email saying the law says they don't need to go back more than 6 years so therefore I can't claim. Is that right ? Is there anything else I can do ?

    Hi

    Had the same reply back from TC today stating its an extraordinary circumstance and I should contact the CAA

    So the options I have are

    1.) To use Bott and Co - has anyone used these and what sort of % of the claim do they take?

    2.) Could you use the legal cover with your insurance? If so how would you go about this? and would they be specialists in the flight delay field?
