    1) Look at the Bott website? But 27%, plus 25€ (and any interest I think).

    2) Look at your policy documents.

There is sometimes data missing from Flightstats

If you plug the details into one of the NWNF sites it may help, however the one I looked at gave
Unfortunately, our data shows that no compensation-related issues occurred with this flight.
It's very unlikely that you will be successful in getting compensation. We recommend not pursuing your claim further.

What reason were you given for the delay. The message looks like it either was not something that was within the airlines control or that it did not arrive over 3 hours late
  • Was anyone on flight TCX 4279 TO BIRMINGHAM FROM Zante on Sunday 28th July 2013 , flight delayed over 5hrs 20 min , Thomas Cook refused to pay compensation and said that no one on that plane have received any form of compensation - took them to small claims court and they have agreed to pay me compensation due to article 7 of the EC 261/2004 Regulation . I would strongly advice to put a claim in and quote what I have said
  • We were on a flight from Florida last Aug and was delayed over 4.5 hours. My claim has gone to CAA and they have advised that TC should pay up now but still TC are refusing too.
Not sure what do now as taking them to court seems expensive, especially if u loose.
Not sure what to do, any suggestions anyone?:(

  • Hi Vauben

Just been reading exchange of views on page 264 of this thread regarding the relevance of how successful other people have been in court, even when the case concerns the same flight.
You have suggested that every case stands entirely on its own merits.

I have to report that my case has now eventually been referred to Liverpool C.C., where the judge has ordered Travlaw who are acting for T.C. to tell the Court if there are any other court cases on going pertaining to the same flight, and also if any other claims for this flight have been to Court, what the judgment was in those cases.
I am aware that judgments in a County Court cannot set a precedent, but it would appear that the judge at Liverpool is going to take a keen interest in any other legal action that has gone before surrounding this particular flight.

    Regards

    CB

Thanks CB. You're right about this - there's also a judge in Norwich who is in the habit of doing the same thing. (There's a great story on the court success thread, I recall.) If you are aware of someone else on your flight who has won in court, it is definitely worth trying to get a copy of the judgement (or a witness statement if possible) - whilst accepting that most judges won't necessarily feel bound by other judges conclusions. Regardless however you still need to take legal action yourself - simply finding a "winner" who was also on your flight isn't going to get you very far.

My other main point however was about the value of arguing that because an airline had previously settled out of court with someone else they would be obliged to settle with you too. Airlines are at liberty to settle with whoever they want without acquiring a legal obligation to others.

So posting hopefully, as some do, "anyone had a success with this flight?" ain't gonna get you very far, unless you're ready to fight in court on the merits of your case.
