  • Picture frame - take them to the small claim court which cost £35 in which you will get your money back when they settle out of court . Go on money claim.gov to apply

    Help please. We are taking Thomas Cook through the small claims court flight TC X0159 6th September 2011

    We have received a notice from travlaw to advise they have requested a stay pending the outcome of Huzar v Jet 2

    How do I respond to the court (ie is there a form I should use) what should my argument be based on. Many thanks

    Are you sure Travlaw are asking the Court for a stay?

    When I initiated court action Travlaw wrote to me requesting a stay pending the outcome of Huzar.

    I read up on that case and decided the circumstances were not the same, and refused on the grounds that our case and Huzar were not relevant.

    If your case is similar to Huzar however, you might decide it to be prudent to agree.

    Hi they previously asked me for a stay and I refused and they are now asking the court. My situation is that a compressor case failed on a flight rotation prior to mine and therefore my flight was cancelled it must have happened at least 12 hrs before my flight as this is when my flight disappeared off the flight schedule.

    As far as I can see my case is actually based on an argument that they should have sorted another flight out in a timely manner- not necessarily that a compressor case is not an exceptional circumstance- although I would argue it isn't

    This was my flight prior to yours, my case has been stayed without the input from Trav law. The compressor failure on take off. This is a knock on, do you have any info from TC confirming this incident or evidence regarding my flight?, we could work together on this.

    Hi Batman 44 where was your flight from and when was it scheduled please? We were flying Sanford to Manchester. The only info I have is that there was a compressor case failure on a flight rotation prior to mine

    I have been seeking compensation from Thomas Cook flight delay on 12/9/13 from Sanford to Glasgow. The CAA have ruled that Thomas Cook's response of 'extraordinary circumstances' is not valid and have asked them to pay compensation. TC have stated that they are defending their claim and are refusing to pay compensation. Any advise as to where I shoudl go from here?

    There was also a Sanford to Manchester flight delayed similar to us on that date and I am sure the same excuses will have been presented to any Manchester passenger tryign to claim.
