    Quick question for the more legal, court savvy people on this thread....

    After my initial claim has been denied, and emails exchanged, I'm at the point where NBA/MCOL needs to happen. I'm going DIY route.

    But in light of the Huzar appeal due next month is it advisable to hold fire until that is heard? Or shoud I proceed and get my claim on the track? Or is secret option 3 - toss a coin? :)

    p.s. Has anyone ever been offered cash compensation and asked if they can have vouchers? ;)

    Thanks Centipede! I've got two delays to claim on and both are under 2 years - June 2012 and 2013, so I can afford to wait for Huzar appeal, but I'm also keen to get the ball rolling now, after reading through these forums repeatedly for the last few weeks.

    And I'd accept payment in sausage - but only if it was Chorizo! :)

    If the airline's appeal in Dawson is upheld, many claimants who may be just within the 2 year limit right now might be out of time unless their legal claim has been commenced within the 2 year Montreal Convention deadline.

    I've not read much on the Dawson appeal, so thanks for pointing that out. Really appreciate your input! Thanks!

    Is it me or did the original writer of this post recently delete a bunch of stuff?

    I can't seem to find the bits about how to make a claim using MCOL including a post from someone else with an example reason to use.

    I also don't understand why in the Thomas cook thread there are details for several other airlines?

    The FAQs are copied and pasted into every airline thread so there will me mention of other airlines but the process is the same for every airline

    Claim submitted with Bott on 25/02, received this email this evening from Thomas Cook.

    TC refused to pay compo to us citing extraordinary circus for delay (tech problem)

    Took case to CAA who said that it wasn't classed as EC's therefore compo should be paid. They said TC had agreed to pay it.

    Had letter from TC yesterday saying that they were not paying up blah blah and saying I was welcome to take legal advice etc.

    Waiting to hear again from CAA but fuming that TC are not paying out.

    Any ideas?

    I have had the same response from the CAA for TC to review my case, they still refuse my case is now pending Huzar.

    This is blatentency at its best by airlines totally taking no notice of the enforcing body, I think a major fines should be imposed on
    1) The CAA
    2) The airline

    You can claim compo for train delays etc, and the regulatory bodies for other sectors can enforce fines on the energy suppliers, banks, etc. The whole thing stinks IMO and I hope the courts tell them in not so many words in May! I think money has already been allocated for compo in this new financial year pending Huzar.
