    In the particulars of claim within the MCOL form it asks for a brief summary and has a checkbox that asks if you are submitting 'the particulars of claim' I filled in the summary and left out the particulars of claim thinking it wasn't required for some reason but after reading the request for judgement it suggests that this should have been done as per the rules.

    The rules suggest you need to send the details within 14 days but I have no idea what to send or where. There doesn't seem to be anything on the website to enter them in.

    Does anyone know anything about this or whether I need to have done it to request a judgement if TC doesn't respond?

    There's a helpline so I would ring and ask them. I suspect that TC will file a defence and that it will be allowed even though it's outside the time limit. I hope not but just to manage your expectations.

    So long as your summary captures the essence of your claim, you don't need to worry yet about expanding it further until you start to compile your bundle (once you've got a court date).

    My own MCOL particulars - all in the box - went as follows, and were more than sufficient:
    I am claiming compensation for myself, my
    wife and our three children under Article 7
    of EC 261/2004, pursuant to the Sturgeon
    judgment in the ECJ (Case C-402/07 of 19
    November 2009), which provides for €600 per
    passenger to be paid in the following
    circumstances.

    These were that Monarch delayed our flight
    from Sharm el Sheikh to London Gatwick on
    08/04/12 and did not return us until
    09/04/12, a delay of some 24 hours.

    Despite writing to Monarch on four occasions
    since this event, most recently on 27 January
    with a final notice before action, they have
    declined to respond to my request for
    compensation.
  • Hi all. Myself My husband and two young children were delayed 5 hours coming home from turkey. I have been refused compesation twice so contacted the caa and they are in agreement vthat the airline should pay as it was not extraordinary circs. What is my next step, would it b small claims courts . Thanks in advance

    Just wondered if anyone has ever had a case with a flight delay with thomas cook which the CAA have said we are entitled to compensation for and have told TC this but they are still refusing to pay out?

    Can anyone advise me what the next steps to take would be or is anyone in a similar situation in the past and managed to get it sorted?
