    Thanks everyone for your help.

    (Vauban) I actually have read the FAQs (and I do understand them thank-you) and have been gathering paperwork together - my question doesn't specifically relate to anything that can be found there.

    My query was more about experiences people have had when pursuing their own claim... hopefully I become inspired by reading the "Court Success" thread you mention.

    I am quite tempted to fight this myself. I do have a legal background but re-trained as a nurse 7 years ago.

    Just a quick update on my claim....

    Passed to info onto a nwnf company, got a reply today that says if i have not got proof of boarding passes or tickets or emails etc they cannot pursue the claim !

    All i had was the booking ref number and a claim ref from thomas cook stating that the delay was out of their control.

    Oh well, good luck to all others

    After the above post i decided that was as far as i could go without proof of paperwork so let the dust settle.

    Last week i had an email from the CAA finding in my favour and have asked TC to pay Comp etc.

    Today i had an email from TC.... Quote,

    Having carried out a further investigation into the delay to your flight, a payment of compensation is applicable in line with Regulation 261/2004. I have taken the liberty of sending you a discount voucher which will arrive separately, to the value of £1,014, which equates to a payment of £338 per person. This voucher can be used against the cost of a future holiday with us, full terms and conditions of which are below the voucher.

    If i ask for cash payment instead what are the chances of them withdrawing the claim again......

    I wasn't having a go at you swifty: at least you didn't ask whether you had to accept vouchers ...

    But whilst your question - DIY or NWNF - isn't specifically answered, it really depends on whether you can a) get your head around Wallentin and b) have the competence and confidence to pull together a case and c) have the many hours of time required to do this yourself. My claim was worth €3k, so was definitely worth doing it myself (plus I enjoyed the thrill of the chase and sense of restorative justice). If my claim was only worth €250 however NWNF would have made more sense.

    I wrote up my account comprehensively - with attached documents. Hope those are useful to you.

    The chances of them retracting their offer are nil. They had admitted you are entitled, so must pay you in cash on request.

    Haha thanks Vauban.. I can definitely get my head around the case law.. it's probably more about whether I have the time. I'm on nights for the next two weeks so whilst there is a lull as there sometimes can be on nights, I shall do some reading and research.

    What strikes me as odd is that how some people get an automatic payout from TC and others don't. The email I received from CAA said that they had contacted TC and that TC would be contacting me to arrange to make the payment!

    Anyway, I will keep you posted.

    Hey and well done on your success. Mine is worth about £1,500 as 3 passengers so would be a shame to lose 27% :eek:

    Hi everyone , my first post on this site so bear with me .
    After a 5.5 hr delay from Antalya on a golf holiday i decided to pursue compensation under the EU ruling . To my surprise the airline didn't contest my complaint and have awarded my golf party compensation of £2700 in holiday vouchers . Am i correct in saying ( as we don't want vouchers) i am within my rights to ask for cash to this amount .
    If this has been covered several times in the forum i apologise for my ignorance in not trawling through the past posts , thanks .

    How did you manage that? Was it Thomas Cook.. I'm guessing it was seeing as this thread is TC related? Just don't understand how some people get automatic payouts and others don't. I suppose others on your flight have already been successful and it was more cut and dried. Mine was an 8 hour delay and the technical fault has been deemed by the CAA not to be "extraordinary circumstances".. and we got changed to another flight which was also delayed due to a so called technical fault! Don't understand why TC don't just cough up!
