Ive followed this thread since Nov 2012 (flight delay to vegas) Fantastic tips and help.
I now have a court date 29th Jan. All docs to be filed 15th. i did mine before xmas, and Thomas Cook dated theirs 15th, arrived Sat 17th . No surprise, enclosed a proposed order suggesting a 'stay' for 3 months pending the Huzar outcome.
Im dropping off a letter opposing this Monday.
They have attached a statement from thomas cook senior operations and customer service analyst in support of their defence.

Has anyone else had this. If so, more tips will be useful. They also say the actual appeal on huzar is to be heard shortly. I thought is was an application for permission to appeal.

Anyone got any up to date info i can use in my letter to the Judge?

Any assistance would be gratefully received. Am now getting v nervous.

    Thanks

Ju499 my only comment would be not too be nervous! With respect to Huzar however you are correct see http://casetracker.justice.gov.uk/listing_calendar/getDetail.do?case_id=20133277
How TC know the outcome is 3 months away is beyond me - the fact that they do not know much about the case should help with your nerves.

    Hi

I was delayed for over 3h on a flight from Manchester to Tenerife TCX6412 on 26/10/13. Before I start the process can anybody clear up teh situation regarding boarding passes etc? I have the booking reference for the holiday, but the boarding passes and flight tickets are long gone. Do I need them? Is there a standard procedure for obtaining them from TC?

    Thansk in advance

You may need SOME proof you were on the manifest therefore research via this website and you will see plenty of posts regarding SAR's, email confirmations, credit card bookings etc

well I have bit the bullet so to speak , got off my butt and finally decided to try and claim - we were delayed in Menorca august 2008 well over six hours . just done everything and will post letter tomorrow ,found booking reference and letter form travel agents so I'm hoping that will do the trick - used the template from here, so nothing ventured nothing gained .

Good luck - but don't be too surprised to get a letter saying "extraordinary circumstances" ... [And don't send any original documents either!]
  • hi money savers

I submitted a claim with Thomas cook for myself and 7 other people who booked a flight on my package holiday booking in 2009. the Thomas cook flight was delayed for over 24 hours due to technical problems. when I initially complained Thomas cook rejected the claim stating that the technical problems were beyond their control. I then complained to the CAA. 6 months have passed and now I have received an email from Thomas cook that implies they have now accepted my claim but they need boarding passes or a booking reference number or invoice to process my claim. I don't have any of these I only have the flight number. they say they have no records of my booking on their systems although they never mentioned this to me in their first response to my complaint.
does anyone have any advice on how I should proceed or how I can prove that my party checked in for the flight.
any help would be appreciated. thanks:)
