    David_e we were never advised that there was any compensation scheme by any of the airline/tour company staff

    To cut a long story short I had a flight delay back in June 2012 since then they have just fobbed me off with the fact compenstion is not due etc etc.
    I wrote to the ASEA who are the CAA for Spain who has stated that they flight was NOT extraordinary circumstances and compensation is due since then even after letters, emails and facebook wall posts it seems they are avoiding me as this is the best way I guess of not paying up.
    Unless anyone has any other information I feel small claims court is the only option not bother about the time of money just the fact they feel they can take money from you not offer the agreed service then not be accountable.
    Anyone?

    You have it right. Legal action is the only thing likely to get you your compensation. For what it is worth, I would attach a copy of the AESA "ruling" just to give them one final chance to do the decent thing.
  • Was anyone on this Thomas Cook flight from Dalaman airport which was delayed for 16 hours on the 19th august 2012. I have claimed for compensation which has been rejected and am now waiting for a reply from the CAA. Ta.

    Quite a surprise, so i entered into online chat with John, who told me that french air traffic control were on strike 0n 11/12th june 2013.. AND even though this had nothing at all to do with the fact that TC had a problem with a part on the plane, (confirmed over PA to passengers when we finally boarded by Pilot!) and we were waiting for the part/engineer? to come down from Manchester or somewhere I believe, TC would argue that ATC france strike was cause for the delay !! how absolutely infuriating, they can therefore blatantly lie and get away with it?? and save 400 euro x 7!! No way of me proving it, so they win. I think its deplorable behaviour. But we all knew that didn't we?

    So, the bottom line here is, if you are trying to get any compensation for this flight, (or any on 11/12th June 2013 it seems) save yourself the pain!

    I have also recieved replies from thomas cook for flight TCX162 this was delayed going from manchester to cancun , the flight was turned aorund after 2.5 hours due to mechanical fault with the weather radar they claim this is extradoinary circumstances??? however it states in the regulation that mechanical faults can be avoided with correct maintenance. CAA very unhelpful in this matter I am now going through the small claims court

    Actually, I don't think it does say this in the regulation (or indeed in any authoritative legal document that I have read). The airlines argue, with some support of the CAA, that proper maintenance means that if a fault occurs it must be extraordinary. But obviously this isn't correct either.

    The test is a straightforward one, set by the binding Wallentin judgement: a technical problem is not covered by the concept of ‘extraordinary circumstances’ unless that problem stems from events which, by their nature or origin, are not inherent in the normal exercise of the activity of the air carrier concerned and are beyond its actual control.

    Just got home from work to find a letter and a voucher for £1006.00, I may ask them to change it to a cheque but that aside I think this is a first, getting a payout in full following a first letter.

    I wont transcribe the whole letter but the key line says:

    "In line with our obligation under regulation 261, I would ask you to accept the enclosed voucher for £1006.00."

    Very happy and have not even needed to ask any advice on the forum but thanks to everyone for all the information and template letters :)

    Anyone else on flight TCX242 on 02/12/12 should get a claim in ASAP and contact me for a copy of my letter if they have any trouble with payout.

    Can i ask what the reason was for your delay ?
