Actually, I don't think it does say this in the regulation (or indeed in any authoritative legal document that I have read). The airlines argue, with some support of the CAA, that proper maintenance means that if a fault occurs it must be extraordinary. But obviously this isn't correct either.
The test is a straightforward one, set by the binding Wallentin judgement: a technical problem is not covered by the concept of ‘extraordinary circumstances’ unless that problem stems from events which, by their nature or origin, are not inherent in the normal exercise of the activity of the air carrier concerned and are beyond its actual control.

If you are still asking this question, I don't think you are in a position to start a legal claim yourself. My personal advice would be to approach a NWNF firm and see if they can help you: they'll charge you about 30% of your claim.0 -
Just wondering if anyone else was on this flight. I made a claim for compensation as we were delayed in Sanford for around 4 hrs. After several months of emails I was offered £100 compensation voucher for no information or welfare provided to us at the airport, as a goodwill gesture ! Today I received an email from Thomas Cook to advise they have closed my case as they are sticking by there extra ordinary circumstances. I am extremely unhappy.0

Yes I will do that. When I asked them for explanation they advised me to contact CAA. I have since asked them if they have sent full Technical Report to CAA for me to look over. My reply was case has been closed.0

This is a copy of the post from Gilly today > "My experience is that the CAA are a waste of time. I contacted them at the start of September and they missed their timescale. I expected this after reading this forum but thought that if the CAA backed my claim then it may help.
I have had nothing from the CAA since and then I got an email from Thomas Cook yesterday saying that the CAA had been in touch with them to review my claim, which 'after investigation' was rejected yet again.
So it's taken almost 5 months for the CAA to basically pass the buck, which would have put me back to square 1 had I not decided to get a NWNF lawyer to pursue my claim. "0 -

One sure way is to check the MEL list for your aircraft, I take a guess and suspect it was an A330. Google Minimum Equipment List for A330 and that will give you a list of go -no-go items, if it's a go item then you have a claim or you could put your details in a NWNF claim search to see if you have a case. Even so tech breakdowns are not EC.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)
