If you are still asking this question, I don't think you are in a position to start a legal claim yourself. My personal advice would be to approach a NWNF firm and see if they can help you: they'll charge you about 30% of your claim.

I have spoken to the small claims court who are much more helpful and you get 100% off your claim with an admin charge.

This is a copy of the post from Gilly today > "My experience is that the CAA are a waste of time. I contacted them at the start of September and they missed their timescale. I expected this after reading this forum but thought that if the CAA backed my claim then it may help.

I have had nothing from the CAA since and then I got an email from Thomas Cook yesterday saying that the CAA had been in touch with them to review my claim, which 'after investigation' was rejected yet again.

So it's taken almost 5 months for the CAA to basically pass the buck, which would have put me back to square 1 had I not decided to get a NWNF lawyer to pursue my claim. "

this is exactly what happened to me with the CAA complete waste of time !!

After months of nothing from the CAA, i got a email from TC relations saying the CAA have contacted them to review my case! Wow! it's been in legal for the last 3 months but they still refuse to payout. I think more ammo for the court as now they have been told by the CAA to pay up! Maybe it could be because of all the info i have requested from the CAA under the FOIA.

My niece and I booked to go to turkey 13th September which was my birthday.. We were due to fly at 6:55pm.....Two weeks after booking we were told we would be flying at 6:55am as they couldn't fill the later flight.

So we both struggled to book an extra day off work.. on the flight day we got to Manchester airport at 4:15 am and went to check in desk where we were told we have already checked in... We said that's not right as we had only just arrived... the desk person ignored us and went off with our passports to make a phone call.

When he came back most people had already checked in.. He told us quite rudely to go to the service desk of Thomas Cook... We got to the desk and were told we were still booked on the evening flight...
We were so upset as our Turkish friends were arranging a party for us that we were now going to miss... We were told by Thomas Cook that the company they use Flexible trips were to blame as they didn't update their records when our flight times were changed.

We didn't ask for our flight times to be changed so we were really annoyed now. We were told the next flight was at 11:30am with jet 2 but it was only 4:45am and we would have to wait until 9 am when they open.... There were two other people this had happened to and we hung around with them.

It turned out that flight was full and the next one was going to be 4:45 pm. We were all given £20 meal vouchers and told we would have to accept that we were not going for around another 7 hours...I was upset as I was going to miss my own birthday party and not arrive in Turkey until approx 02:45am instead of 2:45 pm so this lost us a whole day which we spent in Manchester airport.
We were in that place from 4:15 am until 4:45 pm.

When we got through to departure we rang flexible trips and asked for a taxi to Marmaris from Dalaman and they refused point blank saying 'we have already paid for new flights for you we are not paying for a taxi as well...'........the next day we were so tired we couldn't really do much. I missed my birthday and spent over 13 hours in the airport.

Thomas Cook told us to write a complaint letter on return which I did and this was handed in at our local office.. This was 3 weeks ago...I told them I want our flight costs back and compensation... since then we were told our case was closed but we got an apology via bog standard letter.

Thomas Cook use a company called Flexible Trips to help them fill their planes. We booked totally with Thomas Cook. The day we booked we got documents confirming our bookings but when tickets came via email the times were different to our confirmation docs.
We went to the branch and they told us its due to the later flight not being full.
So we only had one set of tickets showing the 6:55 am flight which Thomas Cook told us Flexible Trips had not updated on their systems.

It seems Thomas Cook use Flexible Trips for admin purposes.

So, we were stuck in limbo for 12+ hours.

We went into the branch we booked our Holiday in today 3rd November and we were told that is the end resolution as far as they are concerned.
I printed a copy of the CAA regulations on 'denied boarding' showing due compensation of €400 each and they basically told us ' We flew, end of'....

I am not sure of our next step as I know we are not blame for this fiasco but Thomas Cook say because we were NOT booked on the 6:55AM flight (even though the tickets we were sent say we were) they have nothing more to say. I am raging now as they changed our flight times NOT us and we even went into their branch to check that we had been moved to the 6:55AM flight from the original 7pm booking and now we don't know what to do.

update: yesterday thomas cook have offered us £100 in vouchers....i have now told them i'm taking the court route...cheek of them!

Any advice, still waiting to hear from CCA with regards to our complaint

Did you follow the advice Mark2spark gave you on 17 December or the advice Vauban gave you on 29 December? If not, I'd start there.

I'm going to vent a little bit now. I think it is justified.

It is frustrating enough with folk coming onto the forum and starting their own threads with obvious questions that ten minutes of reading of the FAQs or other posts would have answered.

But now we have a different kind a user - and there have been a few of late - who does most of the above, and then - after someone takes the trouble to respond - simply reposts the same question a bit later, as if they haven't even bothered to read the answers to their own queries.

So I'm going to stop responding to these kinds of posts, which can be answered with a bit of reading. I won't post a reply unless it is a genuinely new question or interesting development. There really is no point.

I do want to help people - but not if people aren't even helping themselves.:o

    Mandy1955,
You will find all the information you need on page 1, follow the links and read the information. We all started at page 1. the info you require
    http://forums.moneysavingexpert.com/showpost.php?p=59667671&postcount=215
I would suggest you search all the forums for the info and some templates to use, the more you read and learn the more confident you will become to take on the big airlines. Some people prefer to use a NWNF company but they would take a percentage and a small fee but they would do all the work. Forget the CAA as they will not do anything. Good Luck
