  • thanks, but what should be my next move?

Why were you delayed? Was it the airlines fault?
If so contact the CAA if you havent done so already and then send or email (which I did) a letter to Thomas Cook giving them 28 days to respond or you will take court action- you can download a template letter for this for free of numerous websites and then just fill your details in, I did this and had my cheque 5 weeks later
  • cause of my delay was the loader unit loading the aircraft malfunctioned and damaged a cargo bay panel, so dont know where to go with this, centipede100 thanks for your prompt response but not sure i understand what you mean with your reply regards references etc, sorry but im new to all this claiming, legal stuff etc etc and am slightly out of my depth if the truth be told.

i would still contact the CAA with your claim and see what they say about it also download the action before court form and send that as that seems your only option as they are not going to admit liability so easy!
  • i will contact the CAA in the morning but going to small claims court etc might be too late as i believe its 5 years in scotland as opposed to 6 in England and Wales, dont know if someone can confirm this.

If you are referring to me, no I did not, it just seems on here that people are quick to slate off holiday companies, and portray that it is so difficult and they had a bad experience, and how they had to fight tooth and nail to get anywhere.

Right, can you imagine the number of flights over the last 6 years? No neither can I, but it must accumulate to quite a few.

So then, imagine how many people are sending in complaints now that the ECJ ruling has come into force.

So why are people putting demands of write to me in 14 days, that is never going to happen is it, so therefore it is down to individual expectations.

What does concern me, is that there will come a day soon, when ordinary folk like me, will not be able to travel abroad, as I have enjoyed doing over the past 25 years, due to Tour operators having to increase their costs due to Europe deeming that we have to lay down and play dead, (not just the airlines cases either)

I take it then from your remark then, that no one else is entitled to an opinion on this website, unless of course it matches yours and your friends.

Sorry for the intrusion, I will not make this mistake again.

Less than 1% of flights are delayed / or cancelled long enough to "qualify" for this payment. That would stick between four to six euros onto a ticket price.Hopefully, efficient well run airlines will prosper, and airlines that think it is reasonable to dump their customers in a departure lounge with 5 Euros to sustain them for eight hours in a hot over crowded departure line will go to the wall!

Standard impersonal template rejection letter from TC. Send them a 14 day letter before action to explain and prove these "extraordinary" faults. If they can't (or won't) then file a court claim.

Thank you for you help
I sent them a 14day letter this is the response....
    Response today....
I have done all my investigations and am pleased to inform you that under regulation 261 we will be paying you the sum of £712 for your booking reference ****** flight number TCX2946, which you should receive within the next 28 days.

I have read over your last response about your other booking reference ****** flight number TCX2869, as I had said on my reply to your other case the airline are defending this claim as being under the category of 'Extraordinary Circumstances' so we will not be able to offer any compensation for this.

I have been claiming for 2 flights as you can see above... I have been sucessful on FLIGHT TCX2946... However they are still saying that for FLIGHT TCX2869 is 'Extraordinary Circumstances'
I have found a letter that was given to us as we arrived home after being delayed 19 hours that states 'unforeseen operationally significant defect' Do I need to go to CAA? or straight to Court Proceedings? :oSorry Im finding this a little confusing what step to take :o

    Many Thanks
  • Hi,

I have registered with Flightstats but cannot find anywhere to check the status of my flight - TCX4033 from Tenerife to Birmingham scheduled to leave 07.08.12 at 19:50 arrived at 00:05 on 08.08.12. As far as I can remember it was approx 3 hours delayed, although it may just have felt that way with a tired and upset 18 month old daughter!

Hope somebody can help and tell me where I find the info.

    Thanks,

    Steve
  • Thanks Centipede100,

I'm in awe at your quick response, I still can't figure out where to look on the site!! Missed out by 9 minutes, oh well you win some, you lose some.

If anybody sees Ricky Hatton can they tell him he should claim, saw him in the airport and his Easyjet flight to Manchester was delayed much longer than ours.

    Thanks again.
  • Can someone give me some advice?

My flight TCX 27 from Sharm el-Sheik Intl Airport to London Gatwick Airport was cancelled on 04-Jun-2009 for 29 hours. I think im entitled to €600 per person, because the distance is 3860km.

At the time they didn't tell us why it was cancelled.

Because this was over three years ago I cant find my ticket or booking reference anywhere. Do I need it to claim? Surely they would have the information in there database?
  • Can people not do a 10 pound subject access request to get ticket details?
