  • We experienced a 26 hour delay returning home from hurghada in egypt in november of last year. Last week we used the template letter from this site and sent it to thomas cook...

    Last night i had a call from them confirming they accept our claim and would be posting vouchers totalling £1200.. my response.. no thank you tot he vouchers and actually due to the miles we were actually entitled to the higher amount of 600 euros per person not the 400 they were offering. They tried to state that due to the flight path we were actually below the 3500 km limit and that google gives the wrong response... luckily i had the mile checker open from a link on the original post which confirmed it was 4140 km away... 5 minutes later another call to say yes we were correct and at todays exchange rate that equates to £534 per person!!! The cheque is in the post...

    Thank you so much!!! i expected a bit of a fight on our hands... but they just accepted it!

    The delay really was a problem for us as we were 2 couples away for our first holiday without our children, and the 26 hour delay meant disruption to our parents who had agreed to mind the children, not to mention the upset at not being able to get home as planned and promised to the children...

    If you are referring to me, no I did not, it just seems on here that people are quick to slate off holiday companies, and portray that it is so difficult and they had a bad experience, and how they had to fight tooth and nail to get anywhere.

    Right, can you imagine the number of flights over the last 6 years? No neither can I, but it must accumulate to quite a few.

    So then, imagine how many people are sending in complaints now that the ECJ ruling has come into force.

    So why are people putting demands of write to me in 14 days, that is never going to happen is it, so therefore it is down to individual expectations.

    What does concern me, is that there will come a day soon, when ordinary folk like me, will not be able to travel abroad, as I have enjoyed doing over the past 25 years, due to Tour operators having to increase their costs due to Europe deeming that we have to lay down and play dead, (not just the airlines cases either)

    I take it then from your remark then, that no one else is entitled to an opinion on this website, unless of course it matches yours and your friends.

    Sorry for the intrusion, I will not make this mistake again.

    The EU taskforce determined that only 0.15% of flights would be affected by compensation claims Judy.
    It's not our fault that TC are showing year on year losses. Perhaps their business model needs examining, not the EU rules and regs (which came out 7 years ago BTW)

    Hi, im a newbie here and have found the information fantastic. I am currently awaiting another reply from TC. I wanted to know if there were any other passengers that were on the same flights as us. We flew from Gatwick to Larnaca TCX1016 on the 15th Aug 2012 with a delay of 14 hours (due to an unforeseen operational defect) and were kept waiting at Larnaca airport for an extra 4.5 hours for all the luggage as it was on another flight. We then returned Larnaca to Gatwick TCX1017 on the 29th Aug 2012 and had a delay of 7 hours (due to an unforseen operational defect). What made it worse for us was we drove from cornwall to the airport and the same home. Very tired.com. Did recieve £5 each for reffreshments once at Gatwick and same on return leg. How nice.
  • I was delayed by 24.5 hours on 21.07.12 when travelling from Jamaica to London Gatwick. The delay happened because a bird struck the wing of the plane and damaged it. We were not given phone calls, meals or refreshments during our 10 hour wait at the airport. We missed our connecting flights to belfast which cost £159 each for a new ticket. I have written to thomas cook twice and have been given a cheque for £9 each to cover the cost of the meals/refreshement which should have been provided. Was any one else on this flight or had a similar experience? I have now written to the CAA.
  • :j HELLO PEOPLE. ME AND MY PARTNER HAVE HAD TWO DELAYS LAST YEAR WITH THOMAS COOK {WITHIN SIX MONTHS OF EACH OTHER} ONE 10HRS AND ONE 13HRS. BOTH CAUSED BY TECH PROBLEMS WITH THERE PLANES. {TECH PROBLEMS ARE NOT CLASSED AS EXTRAORDINARY CIRCUMSTANCES, IF YOU GO TO COURT, THE AIRLINE CANNOT SIMPLY SAY YOU HAVE NO CASE AS IT WAS EXTRAORDINARY CIRCUMSTANCES THAT CAUSED THE DELAY. THEY MUST SHOW IN COURT THE EXACT CIRCUMSTANCES LEADING UP TO THE DELAY SHOWING EXACTLY HOW IT HAPPENED, AND PROVING THAT IT WAS NOT AVOIDABLE. WE ALL KNOW IF A CAR IS SERVICED AND LOOKED AFTER IT WILL NOT IN ALL PROBABILITY BRAKE DOWN. A PLANE IS NO DIFFERENT, THE AIRLINE HAS A DUTY OF CARE TO MAKE SURE THE PLANE IS AIRWORTHY. WE HAVE FILED COUNTY COURT PAPERS AGAINST THOMAS COOK JUST OVER A WEEK AGO. WE ARE CLAIMING 800 EURO EACH FOR THE 2 DELAYS PLUS £80 COURT FEE. I PHONED THE COURT YESTERDAY AND ASKED HOW THINGS ARE GOING I WAS TOLD PAPERS SHOULD BE SERVED ON THEM BY FRIDAY. THEY THEN HAVE 14 DAYS TO RESPOND. I ASKED IF THERE WERE MANY OTHER CLAIMS IN THE SYSTEM AGAINST THEM, AND WAS TOLD THREE PAGES FULL ON HIS COMPUTER. THIS IS THE BEST ROUTE TO TAKE. TEMPLATE LETTERS BEING SENT TO THOMAS COOK IS ONE THING, BUT YOU JUST BECOME A NUMBER IN A VERY TALL PILE. WE ARE WARMED BY THE FACT THAT A JUDGE RULED IN FAVOUR OF A COUPLE IN STOKE ON TRENT LAST WEEK AND DISMISSED THOMAS COOKS EXTRAORDINARY CIRCUMSTANCES DEFENCE. THEY GOT OVER £600 IN COMPENSATION PLUS INTEREST AND COSTS.[THIS CASE WAS VERY IMPORTANT AS IT IS NOW CASE LAW] FOR ALL SIMILAR CASES} WE BOTH WAIT WITH BATED BREATH TO SEE HOW ARE CASE GOES ? BUT IF THEY CONTEST OUR CLAIM I CANNOT WAIT TO HAVE MY DAY IN COURT. GOOD LUCK TO EVERYONE.

    hi a bird strike can proberbly be classed as something out of the airlines control. However you are entitled to be reimbursed for food drink calls etc, and your insurance might have covered you ? The airline have breached the european ruling by not DOING THIS AT THE TIME OF THE DELAY.. And not providing meals etc. Its to late them sending vouchers out to you now.
