    I agree with Maghater that a successful claim will take time and effort and patience - and there is no guarantee of victory (though about 90% of those who start legal action seem to get their compensation).

  • What are the chances of recieving compensation on this flight as the circumstances are a little complicated.

    Due to rtn home 27-04-13 CUN-MAN. apparently our A330 aircraft had gone tech in Cuba day before, so 767 was sent as replacement, which landed CUN only 1hr later than schedule, told because not all available crew trained on 767, it would be delayed 15hrs due to staff out of hours and needing rest, re-scheduled for 07-00 following morning, as pushing back off stand, aircraft came to a halt, advised by captain aircraft had just dropped hydraulic fluid all over runway, so after a while pax taken back into terminal. After a couple more hrs captain informs us a seal has gone, and unfortunately the seals they had in aircraft maintenance kit would not fit 767, advised incoming aircraft may have correct seal as none available at Cun airport, few more hrs pass, crew then go out of hrs again.

    Finally advised they have made a decision, that we will take the incoming LGW back to Man, and the LGW pax will get delayed till 767 aircraft fixed.

    Eventually left CUN 24hrs 25mins late, landed Man given letter to send to insurance company, stating delay due to extraordinary circumstances.

    Recently sent complaint letter to TC, received rejection letter, stating under EU 261/2004 no claim for compensation was due.

    But this in effect involves 3 different aircraft, and is it correct that if I now go to CAA, because the delay was in Cun, they will state I have to go to mexican equilvalent of CAA?

    if you look at the regulations, its the time of arrival that is used for the compensation calculations. NOT the departure. So dont bother with the CAA or whatever equivalent, it just wastes your time. Stick to the program, nba, then file court

They seem 'happy' to pay out all this money on call centres/ defence firms / printing and postage on indefensible cases when, if they were just upfront and dealt with the complaints it would cost less long term and they would keep custom .. I am resigned now to travelling much less often and going with a more reliable airline. I used to love T cook and travelled with them a lot over the years, now I wouldn't recommend them to anyone.

    The point to make to an airline that settles out of court is to demand an email or letter to that effect and the payment is in your account by a date that suits you. You are the one that is in control, once they have admitted liability and you agree they cannot go back.
    In our case they settled by letter on a Monday and we stated to them by email after a short discussion on the phone, if the money was not in our account by Friday we would forwared the papers to the court.
    SURPRISE SURPRISE it was there next day.
  • Hi there! I was delayed by 24 hours by Thomas Cook and would like to begin my quest for compensation. I have downloaded the template letter but don't know where to send it to. Ideally I would like a mailing address so I can send it recorded delivery, but want to make sure it reaches the right department. Any help????

    Hi All,
    Wondering if anyone can help. I have emailed Thomas Cook on the custome relatons email address given by them directly to complain and seek compensation for a delayed flight back in June. However I received some bog standard replied, which I have seen in this forum sent to another customer. I have replied to them with a very legnthy email with all facts and referring to previous cases which have been taken to court and won. I have given them 7 days and now awaiting a reply. According to the regualtion I am entitled to 3 lots of 400 euros so well worth persuing. I am hoping they don't wish for it to go to court as to be honest I dont think I have the time to do that. The first reply I had from them was within the stated time limit I gave them, I wonder if they stick within this time limit. I gave 7 days , I'm not sure this is enough or not, however worth a shot ! Wish me luck !

    If you think you have a genuine claim you will have to put the time in or NWNF.
    It is not difficult may be miss a couple of hours TV in the evenings reading on this forum and constructing a claim. You won't get owt for nowt.

    I think everyone posting wishes you luck however you will need tenacity and patience if you are going to succeed. With over £1,000 at stake don't walk away and if you don't have the time to pursue (this could mean going to Court) at least appoint a no win no fee firm to end up with £700. :)
