    It just helps your case (presume you have in writing) should you need to go to court.

    Thanks for the reply, I presume you mean do we have in writing that it was an Operational Decision to swap the planes! Unfortunately no, it was what we were advised by the Thomas Cook Rep at the airport.

    Is there any way that a check can be done to see what plane would normally do the return journey? I have always presumed that the incoming flight would be the one which you would return on!

    No I meant an operational decision is not an extraordinary circumstance. So if you have it in writing that they are claiming EC's and you know for a fact it was an operational decision they are contradicting themselves.

    Yes planes used for specific journeys can be checked but you need to have full details date/flight number/airline/to/from for all the legs you are questioning - not always listed and in the case of TC a bit hit n' miss. Post here and someone may look up for you.

    Is this extraordinary ?
    Could this have reasonably been foreseen?

    Think its worrying when there's no oil in the hydraulic nose gear thingy and they didnt know until they had to replace the seal!

    Technical problems are ordinary happenings every minute of every day to planes.
    8 hour delay unacceptable an alternative plane from their fleet or elsewhere should have been procured.

    More delaying tactics ??? They seem 'happy' to pay out all this money on call centres/ defence firms / printing and postage on indefensible cases when, if they were just upfront and dealt with the complaints it would cost less long term and they would keep custom .. I am resigned now to travelling much less often and going with a more reliable airline. I used to love T cook and travelled with them a lot over the years, now I wouldn't recommend them to anyone.
    Did get my cheque within a week and lodged same day was available on Monday :j
  • Hi all, I'm not used to posting on forums hope I am in the right place here goes...

    On Friday 2nd August my flight was delayed with Thomas cook as the catering lorry crashed into the plane causing damage to the door seal, they did not have the necessary parts to repair the plane they had to be sourced from Luton hence the delay. We were told at 3 there was a technical problem, then at 6 that we would be flying at 9.30 exactly 8 hours late. The airline gave us letters to confirm the delay stating that we should claim from our insurance for the delay.

    I'd like to know if anyone has experienced anything similar and wether from experience anyone thinks that this may be put down to a exceptional circumstance, any thoughts would be appreciated

  • My first post so please be patient with me! I have had a good read of the majority of posts on here before deciding to post myself.
    I sent my initial compensation claim letter off to TC on 27th July by recorded delivery to the Customer Relations, 2-4 Godwin Street, Bradford address as per the FAQ page at the beginning of this thread. It was signed for on 31st July, 14 days has come and gone and I haven't heard one word from them.
    Next step for me is to send a copy of my letter to the TC address in post 3174, Inmoor Road, Birkenshaw, Bradford - unless there is another address I'm missing?
