  • What are the chances of recieving compensation on this flight as the circumstances are a little complicated.

    Due to rtn home 27-04-13 CUN-MAN. apparently our A330 aircraft had gone tech in Cuba day before, so 767 was sent as replacement, which landed CUN only 1hr later than schedule, told because not all available crew trained on 767, it would be delayed 15hrs due to staff out of hours and needing rest, re-scheduled for 07-00 following morning, as pushing back off stand, aircraft came to a halt, advised by captain aircraft had just dropped hydraulic fluid all over runway, so after a while pax taken back into terminal. After a couple more hrs captain informs us a seal has gone, and unfortunately the seals they had in aircraft maintenance kit would not fit 767, advised incoming aircraft may have correct seal as none available at Cun airport, few more hrs pass, crew then go out of hrs again.

    Finally advised they have made a decision, that we will take the incoming LGW back to Man, and the LGW pax will get delayed till 767 aircraft fixed.

    Eventually left CUN 24hrs 25mins late, landed Man given letter to send to insurance company, stating delay due to extraordinary circumstances.

    Recently sent complaint letter to TC, received rejection letter, stating under EU 261/2004 no claim for compensation was due.

    Any help greatly appreciated please?

    No more complicated than a fair few posts on here. You are entitled to compensation which will be awarded either by you going to court following a lot of research (start off on page 1) or you appointing a no win no fee firm ...... or you could just walk away and forget it.

    Agreed - good luck :) but 100% can be achieved if you have the time, tenacity and patience.
  • Cheque arrived today from TC in payment for flight delay they kept telling me was due to EC and therefore no monies payable. After much to-ing and fro-ing with them and the CAA (useless, sorry but no other way to say it though they are probably overwhelmed with claims in their defence), I decided to go the Small Claims Court route - on first filing their defence they continued to claim EC on the outbound flight (yes, my inbound flight was delayed also). Finally after much more to-ing and fro-ing with the court a date was set and hey presto they re-file their defence to say they will no longer defend on the outbound flight and therefore my compensation is finally due - am very happy with this

    However, we still have the inbound to sort out and I'm busy preparing my papers - no matter what happens from here on in I'm the winner since my costs will also get paid when we get to court as it has taken up till the date setting of the court appearance to get TC to "fess up" and admit their shortcomings.

    A message for all those of you out there who are wondering whether or not to pursue them - do it, they rely on the fact that people won't bother. If you can't be bothered or the thought of doing-it-yourself is a little daunting, then appoint a NWNF firm to act for you - work on the basis that something back is better than nothing

    southy1 - You can find the energy. If I as a working mum with three children can find the time and energy to log on here every day for four months and enter into endless correspondence with the airlines, anyone can. GO FOR IT!

    Quick update - Trav Law have sent me their defence DIRECT, not via the Courts, and asked that all further correspondence is forwarded to them. Checked with MCOL and this is absolutley NOT the case. So if anyone gets a similar letter from this firm, the advice is you do not engage with them, just fill in your Directions form and send it to the Court. ALL CORRESPONDENCE IS TO GO VIA THE COURT, NOTHING DIRECT TO THE AIRLINE OR THEIR SOLICITORS.(unless the Courts specifically ask you to do so)
  • Hi there, We were due to fly on TCX473 from Sandford to Manchester on 12/10/12 at 16.50. The incoming flight that day from Manchester TCX472 had arrived on time. However we were advised that as the incoming Gatwick flight - TCX246 was delayed they had made an Operational Decision to use the Manchester plane to return to Gatwick and subsequently the Manchester passengers would return on the plane inbound from Gatwick which eventually landed at 19.30 and left for Manchester less than 2 hours later.

    Can Thomas Cook class the reason for the delay to the inbound Gatwick flight as the reason for the late departure of the Manchester flight, bearing in mind that the plane due to return to Manchester was in Sanford at the correct time but instead was used to return to Gatwick?
