    I refer to my threads of 1088 page 55 and 2636 page 132
    I have been battling on since 5th Jan 2011 (yes 2011) at every corner TC have tried to block me. I was determined to persevere Eventually I issued court proceedings and it was only then they decided my outbound flight was a technical fault and the inbound was an EC I requested details but got no response. Eventaully a court date was set and then the judge requested a full transcript of
    their claim in the Graham and Anor case as they claim it covered their defence. This appeal concerns a claim for damages and NOT
    compensation. The Dis judge then directed them tofile full statements and to include FULL details of the tech fault and the EC
    I sent in further statements before the due date but no response from TC

    Guess what I then get a letter from TC confirming the claim is no longer disputed and agreeing to settle in full[They have also notified the Court) They have agreed to pay me 1600 euros plus meals plus court costs and as I claimed interest from 2011 on my particulars of claim they've paid that as well. £1.630.55p
    They really have strung this out but it goes to show if you have a valid claim stick at it Its not difficult but does require you to do a bit of reading.
    \I read the threads daily and picked up quite a few valid points from them

    PS I was quite looking forward toa court battle as I think I can handle myself against 3rd rate solicitors and barristers

    Airlines generally use first rate advocates because they can afford it. It's the defences that are third rate! ;)

    I don't see how they are allowed to do this? THe Peterborough address is their HEAD OFFICE. How can they say it isn't right and reissue the court to a semi closed office with a skeleton staff? Is it in case the bailiffs turn up so there is nothing for them to remove? I smell a rat.

    Hi I'm new here and was just wondering if anyone as had compensation for the TCX5625 delayed 17 hours at dalaman flying back to East Midlands on the 6th may 2012 ??? Thomas cook are saying that it was an extrodinary circumstance as one of the switches for the engine was broke flight was actually delayed in the uk n broke in the uk therefore wasn't on schedule for us are Thomas cook right is this an extrodinary circumstance? I've contacted the caa still to hear back from them I'm thinking of doing a mcol would I have a case ??? Also there are 15 people we are claiming for so court fees are £100 if its under £5000 if its over its over £200 if they do pay out do you need to add on the court costs and intrest as this will take it over £5000 also is the mcol fee the only thing I pay or are there lots more costs involved and finally me son was 7 month when we went we payed £30 for him so I'm guessing we can't claim for him so sorry for all the questions

    Read FAQ's on page one then come back with any questions which are not (already) answered there.

    The only question that I can see on there what I asked is about extrodinary circumstance was just looking for other people's opinions don't feel like you can ask anything on here without someone been funny with you

    I understand that regular users will get fed up of the same questions been asked but most of what I wanted to know wasn't in the FAQ as I looked and like I said I was looking at other people's opinions aswell

    Most of your questions will be answered if you click on the MCOL link in the FAQ's.
    The small claims limit is now £10,000 btw.
