    Article 3(3) of the 261/2004 Regs say "This Regulation shall not apply to passengers travelling free of charge .... "

    I suspect the taxes don't count in determining whether the baby's ticket was free so I would say no claim.

    just been looking through forum and not sure we will get refund now as plane was 3 1/2hours late coming in but we gained time on the way back so it worked out we were 2hrs 48mins delayed landing, gutted as we flew from Gatwick which is a 3-4 hour car journey from us and this resulted in my husband having to take an extra day off work unpaid:angry:
    can anyone help me on this or know if I could still make a claim????

    Well what a surprise! Ten days after my date of service via MCOL, TC write to Court claiming a change of address, thereby gaining a further 14 days to respond! For anyone about to issue MCOL against TC, if you don't wish to give them this excuse to delay your case, DO NOT use the address they put on their correspondence i.e. the Peterborough one. And don't list the defendant as Thomas Cook Group UK (again on their correspondence).

    They have sent an amendment to the Court that their correct name is Thomas Cook Airlines Limited and the correct address is Unit 4A Adwalton Moor Business Park, Inmoor Road, Birkenshaw, Bradford BD11 2PS.

    And despite AESA finding in my favour, they have ticked the 'intend to defend all this claim' box. Oh bring it on..................

    Has ayone that was on TCX163 Cancun to Manchester 11 July 2013 received any compensation off Thomas Cook or had emails or letters from them?
  • Have submitted a claim for compensation due to a 5 1/2 hour delay in flight arrival at MBJ.

    Submitted this using Thomas Cook web site form for EU261/2004.

    Included a compensation claim letter but nothing else.

    Would you recommend following this up with a "snail mail" letter with proof of posting?

    Unfortunately we don't have the boarding cards from Manchester but I do have mine from Montego Bay to Manchester, will this affect the claim in any way?

    Have tried searching the forum but there is a lot of irrelevant information returned with out a reasoned answer.

    You are unfortunately out of time - court action must be taken within six years of the incident, even though technically you can claim from the airline back to 2005.

    Surely there must be a way of simply redirecting people to the FAQ's?

    I'm finding myself exasperated as on other forums where I have this level of input, I have admin facilities, and so can just moderate where necessary.
    There appears to be very very little done by any members of the MSE team.

    no you cannot, it is the arrival time that is taken for the delay so under 3 hours = no compensation

    We're just in the early stages of contacting TC re our delays of 8.5 hrs out and 5 hrs return. My friend watches the arrivals info on her tv and has seen it is a regular occurrence!! What hope for any of us to get any compensation before they go bankrupt. Interesting reading thro' this thread from the top - re claim against airline not package agent. We've had no acknowledgement of letters sent to Customer Services in Bradford - even tho' addressed to Harriet Green and quoting some of her comments in the plane's Travel Book. Will try this Unit 4A address now. Good luck everyone.
