Incidentally, I filled in for the mdiation to show willing but there is no way, judging by other comments, that this will happen. Does anyone have advice on what to do next or if someoen phones to mediate? what should we be saying?
    Thanks

Mediator will ask both parties if they are willing to 'give' in any way. Only latitude you really have is to suggest you would be willing not to levy interest if the matter is concluded speedily so long as they meet claim and court costs in full.
In my case, during mediation, the airline offered to pay back my court fees only .... I told them to fly off.

Can you tell me what NBA and MCOL stand for, sorry, I have tried to find answer by looking through previous posts but there are lots! thanks.

PAGE ONE of your airline thread - sorry to shout but you must read everything to find out NBA = Notice Before Action and MCOL = Money Claim On Line.

TC are claiming that an engine change causing a delay means they are not liable, could anyone confirm whether they are lying again I am looking at starting MCOL claim but need to make sure its a valid claim first. (They wouldn't give any information as to the reason for the engine change)

NBA with a 14 or 21 day response with the precise reason for the delay, don't mention the reason they have given you. You may get a different reason which if you go ahead is more grist to the mill.

I am starting this thread for those claiming flight delay or cancellation compensation from Thomas Cook.

Any posts regarding any other airline in this thread will be ignored (at least by me).

Well what a surprise! Ten days after my date of service via MCOL, TC write to Court claiming a change of address, thereby gaining a further 14 days to respond! For anyone about to issue MCOL against TC, if you don't wish to give them this excuse to delay your case, DO NOT use the address they put on their correspondence i.e. the Peterborough one. And don't list the defendant as Thomas Cook Group UK (again on their correspondence).

They have sent an amendment to the Court that their correct name is Thomas Cook Airlines Limited and the correct address is Unit 4A Adwalton Moor Business Park, Inmoor Road, Birkenshaw, Bradford BD11 2PS.

And despite AESA finding in my favour, they have ticked the 'intend to defend all this claim' box. Oh bring it on..................

I shall look forward (not) to the very same occurrence.

YES but more info would help.
  • Very odd email received from TC this week:
[FONT=&quot]HI, NO RECORD OF DELAY, CAN U INVESTIGATE
    Booking Ref: ******

I don't think it was meant to have been sent to my email address?

Funny how their initial response was the delay was due to a 'technical fault which was extraordinary.'

  • I would love to hear if anyone has received compensation for delayed flight TCX2994 from Manchester to Antalya on 11th June 2012.
