The only question that I can see on there what I asked is about extrodinary circumstance was just looking for other people's opinions don't feel like you can ask anything on here without someone been funny with you

Nobody is going to be "funny" with you for asking a straightforward question but you NEED to read the FAQ fully before asking as the answers are there! At the end of the day only a judge can decide if a broken engine switch is an EC or not.The law in it's current state says it is not. Did 1 person book all 15 tickets? If not, I would just start by claiming for the ones you booked personally but you're in for a hard slog to do it yourself either way as TC will dig its heels in for such a large claim. Why not consider handing it over to a NWNF solicitor? Or use your home insurance legal cover if you have it like I did?

Hi yes 1 person booked all the tickets under 2 seperatly bookings Im not really fussed on paying a nwnf company when it's something I can possibly do myself all though it don't seen quite so easy as I thought

I don't see how they are allowed to do this? THe Peterborough address is their HEAD OFFICE. How can they say it isn't right and reissue the court to a semi closed office with a skeleton staff? Is it in case the bailiffs turn up so there is nothing for them to remove? I smell a rat.

the address quoted is their 'customer legal' as they call it, so as far as I know it isn't semi closed etc. This is the office where they deal with all court claims against them.

Don't quote me on this but if you booked under 2 separate booking then I'm sure you would have to make 2 different claims? Or I'm sure TC will tell you that you will!

My point was that surely we are taking Thomas Cook to court and not their hired help? This isn't their head office. Peterborough is so it shouldn't matter what address they deal with the claim.

Anyone have an opinion on this? CAA has published guidance on what constitutes ECs. Dated 23rd July; this extract from what's not an EC seems a bit concerning but not entirely unexpected from the Airlines' friends at CAA?

Full doc. on CAA web site

    "26

    Unexpected
    flight safety
    shortcomings

Any other technical defects which become apparent immediately prior to departure or in-flight (where the system or part had been maintained in accordance with the required maintenance programme) and which require investigation and/or repair before the aircraft is airworthy for the intended flight. "

Bit concerned about this as well, as if this is true everyone may as well drop their claims now as this constitutes nearly all claims. What was the point in the ruling last October EC Regulation 261/2004 if the CAA wont uphold it.

I went to court recently and the judge put the decision in the hands of the CAA, even though I would still take it through the courts and am looking into getting professional legal support to take it forward and go up against the barrister they sent, as the judge admitted in court he knows nothing about this regulation at all. I don’t want to have to fight the judge and Thomas Cook so employing some expert help now to take it forward is the best anwser at the moment.

Hello all. First post. Just want to say I've read every page in this thread and all of the pertinent case law thanks to the huge delay we had with Thomas Cook.

Sent off a letter, as in printed out on paper and sent by Royal Mail. Got a template response of course, but it says "respond to this email using the reply function." WTH? Seriously you cannot even be bothered to check that you are using the correct template Thomas Cook?

Furthermore we sent it to one address but you reply with another address, after we called to ask which address to use for your customer service department? It's not proper letterhead so that's not an excuse, it's all done by printer so it would be easy to change. But who knows, clearly the staff you hire can't be bothered to proofread! The address on the letter they sent was in Peterborough.

If this goes to court I already know not to use that one thanks to all the lovely posters here. I agree with chili2001, surely it doesn't matter which address we use as we are taking them to court not their staff. As the Peterborough office is listed with Companies House as the registered for Thomas Cook Airlines Limited one would assume this would be the address for serving court papers to.

Hey Thomas Cook, did you know that a registered offices is where a business receives important documents such as court papers? Then quit dicking everyone around and stop with the dirty tricks to delay compensation.

Our flight with you was our first and will be our last. Your planes are so cramped my knees touched the seat ahead of me. I'm 5'7". I also nearly sat on a dirty fork left from the last flight. Lovely! And my seat was broken. Comfy. The staff at the airport were useless and wouldn't allow us our phone calls as outlined. Except for one bloke at check in, he rocked.

The flight attendants were decent, considering they were made to work an extra long shift due to your incompetence to sort out a contignecy plan for when things go wrong. A technical fault is not extraordinary. No way. It happens all the time. If it can't be sorted right away you need a back up plan which may include wet leasing a plane and crew from another airline.

I went with Thomas Cook because it looked like a cheap flight. Then I learned we had 5 kg of carry on. What am I supposed to put in 5kg of baggage? Most carry ons weigh at least half that! A hold bag was £38 round trip. It was stated as £17 one way, like that's any better. Most people will be returning with their hold bag and you know it. We shared a hold bag.

I brought food with us as what's on offer to purchase on the plane is a joke. Processed crap at astronomical prices.

According to the stats about the punctuality of our flight, it's delayed 40% of the time. Impressive.

I don't think budget airlines are money for value anymore. The margin of price difference between a budget flight and another flight is almost nill when you factor in hold baggage, food, and other charges.

Bit of a rant, sorry forum posters. Will update with what their excuse is.
  • Hey sging1, what you're referring to isn't case law and can't supercede Wallertin. So carry on.
