  • Hi I'm new to this so sorry if I ask anything that seems abit obvious. Me and my boyfriend were delayed 4 hours and 5 mins in lanzarote for flight TCX7125. We were told in flight that it was due to damage to the aircraft (I'm sure they said the fan?) that required a specialist to check. We were told they had to get the specialist from gatwick to give them the ok to fly the aircraft; so I'm assuming the delay began in the uk. We've requested €400 compensation per person. We wrote to Thomas Cook so we will have the coppies of everything we send them and they send to us should we need to take our claim further. We sent a copy of our original tickets aswell as information from flight stats detailing the delay time. We just wondered if anyone else has put in a claim against the same delay or any helpful information or hints or just anything really.

    Sorry if I've posted this twice, I thought I'd posted on here a few days ago but if I have I can't see it anywhere?

    Well, following a rather protracted battle with TC, the money arrived in our account today.

    A massive THANK YOU to bgwuser and also to 'a n other' for their assistance in getting to the end of this.

    Just to assist anyone further ..

    We flew Paphos (Cyprus) to Manchester on 16th October 2012 on TCX2027 which was delayed by 7h 20m
    The 'outbound' flight TCX2026 was delayed and ours was therefore also delayed as a consequence.

    I can also provide claim ref's if required.

    We were on a flight No. TCX6219 this was from Mahon to Newcastle on the 17th May 2013 ( It was also delayed for over 8 hours) Could there be two TC flights with the same flight numbers?
    Can anyone advise.

    Yes, it's the date that differs.

    Three phone calls, 3 emails with all the necessary details re flight compensation and bingo 4 weeks from start to finish cash in account today :p Our flight was delayed 5hr 40min and compensation paid was 400 euros per person.

    No problems at all...Happy, happy :beer:

    Now that I have a few weeks at home and time to dedicate to the TC compensation claim I'm not entirely sure what to do next.

    Let me explain - I sent my initial letter to TC at the beginning of January 2013 with an acknowledgement received 4 weeks later. Then around 4 weeks after that came the usual rejection letter.

    I then replied in mid March with the Notice Before Action letter as I was not accepting theor rejection letter.

    Around 6 weeks later I contacted TC via their Web Enquiry form only to receive this reply:
    Thank you for your web enquiry form. I have no other communication from yourself on our system and no attachment on your web enquiry .
    Please can you forward it by reply to this email and I will action as appropriate.

    I then responded to this email and resent all the documentation but noticed that I now have TWO Case References for the SAME Booking Number.

    I instigated the CAA investigation and sent all the documents to them. Their reply on 9 May 2013 informed me that a full investigation will take place but "As I am sure you will understand, an investigation of this nature will take months rather than weeks".

    2 months further on I am now have time to take TC to court.

    The Question is: Does my NBA letter have to be actioned within a given time period as this was sent between 3 and 4 months ago.

    No, it doesn't 'expire' or have to be actioned within a certain period of time.

    One word of warning though, issuing Court Proceedings can sometimes be a very lengthy and involved process.

    It's therefore important to make sure that you've not just got the time to deal with it now, but you'll have sufficient time to deal with each step of the process over the coming months.

  • TCX2502 - 22nd September 2012 - Manchester to Izmir - delay over 4 hours.

    After reading this board and using Martins letter, I wrote to Thomas Cook. Received the acknowledgement letter yesterday. They have provided a case ref number and I now await their response - I will post when I have news, hope this may help others who may have been on this flight.

    Claiming for 2 adults for a 3 hour 10 mins delay flight no TCX 2774 on Tuesday 2nd August 2011 from Manchester to Dalaman. There was no pilot available. When we eventually got on the plane the pilot apologised for the delay & explained he'd just had a 4 hour drive up the motorway so that he could fly us to our destination.

    Initially I had no documents (can't believe I had a clear-out of my emails just a week before I realised I could claim) so just sent names & passport numbers. I received a reply within 2 weeks saying they couldn't find us on their list & wanted me to send booking ref etc. Finally managed to get copies of documents from holiday gems, including ATOL certificate so will send everything off tomorrow.

    Fingers crossed all goes well!
