Flight delay and cancellation compensation, Thomas Cook ONLY

Hi all - spent the last 5/6 months battling TC - incidentally each time I received a response from them it had a different case no! Continually refused comp, until I got the CAA involved about 8 weeks ago - though and behold received voucher for £1749 in post today - will be requesting cheque!! Keep persevering!0

TCX163 Cancun to Manchester was delayed for 30hrs 20 mins was due to Depart Cancun on 11 July 2013 (15:15 local time) Actual time of departure 13 July 2013 (21:25 local time)
Does anyone know how much compensation I can claim from Thomas Cook.0 -
Hi all, looking for advise re our Delayed Thomas cook flight today!
We arrived at airport, Dalaman and were informed a 1 hour 30 min delay. Ok not too bad we thought, original time to leave was 2pm local time, we boarded at 3.30pm and pulled away from the stand at 4pm ....... 10 minutes later we were told they had a technical fault has occurred and we would have to go back to the stand for the error to be corrected. This, plus waiting for paperwork to be completed, then a problem with the disconnection from power causes further problems and further delays ...... We eventually left 7pm ! Five hours late ! 3 hours or which we were made to sit on plane !
Obviously people on board started talking compensation but apparently the captain said to one traveller we would be unable to claim compensation as they taxied to the runway originally only 2 hours late !
Obviously i am going to be writing to Thomas cook but in the meantime does anybody know if the captain has a point or was he just trying to persuade passengers not to bother trying to claim !?
Edit to add: just checked on flightstats website, says flight was delayed by 268 minutes, so think thats an official delayed flight !0 -

European precedent case law makes clear it is the time you arrive at your destination - not how delayed you are at take off - that matters.0 -

Please, please, please can somebody advise. I booked a package holiday with Thomas Cook on the 27/06/13 paid for in feb 2013, myself and my 5yr old son plus my mother with mobility issues. The airline delayed us 10hours going out to Palma Majorca, our 1st night was spent in Manchester airport. Arrived to our hotel at 4.30am no time for breakfast and was completely worn out the following day. Furthermore on our return journey to the UK we were then delayed 7 hours. There was nobody to advise us. All the people were completely took back by this. Everybody is going to lodge a complaint? my question is where to start, Thomas cook advised i will receive 25 pound back per passenger. i cant believe the start to our holiday and the end to it, i saved for two years to take my son and my mother away. Light refreshments were provided at Manchester airport, which was salad, i had to by tea and coffee while other peopole hit the bar. on our return i was given 7 euros to buy something to eat from Palma. Do i have the right to complain as its not the money its the prinical. whatever you do, do not just thomas cook book it.0

First of all, I assume it was Thomas Cook Airlines that you flew on both directions? Also, were you told the reason for the delay each way. Post back with this info and we will try to help you.0 -

Hi,
I was wondering if anyone could point me in the right direction with the horrible end to a holiday we had on 11th July 2013. (TCX163 from Cancun to Mexico).
The first we heard was that the flight was delayed from the original time of 15.15 by 8 hours (found out after we had checked out and waited for our original pick up from the hotel). We talked to our rep before checking out who told us there were no delays so to go ahead and check out, when she talked to Thomas Cook after the bus failed to show they said they had emailed our hotel to stop them checking us out early due to the delay. The hotel denied receiving this and no-one had informed our rep. Therefore we were made to sit in the hotel for 8 hours with no room to shower etc.
Once we arrived at the airport and checked in we were waiting until 11.15pm (the stated departure time after the initial flight delay) until we heard there was a fault with a weather sensor and if it could not be repaired we would not be flying. After the captain made the decision not to fly we were provided with a small pack containing a muffin, yoghurt and a small orange juice but no other refreshments apart from water 'for children only'. It was 4am before we were allocated a hotel room and transferred by coach.
We were told we were to fly out at 7pm the following day so were picked up at 4pm from our hotel only to spend more time waiting until our flight actually left at 9.25pm. We were given no refreshments or vouchers towards food/drink at this time and had to purchase our own.
I was wondering what, if any, compensation we were entitled to with all of this? We received a letter on arrival at Manchester stating that Thomas Cook package holiday customers are 'not entitled to a refund of the total price of the package unless the flight is significantly delayed causing a reduction in the time spent in the destination which is significant in relation to the length of the holiday'
I have filled in a letter from the information on this website to send to Thomas Cook, but am expecting they will dismiss their responsibility.
Sorry for the lengthy story! Any help would be appreciated, I've never had to do anything like this before.0
