I was wondering what, if any, compensation we were entitled to with all of this? We received a letter on arrival at Manchester stating that Thomas Cook package holiday customers are 'not entitled to a refund of the total price of the package unless the flight is significantly delayed causing a reduction in the time spent in the destination which is significant in relation to the length of the holiday'
I have filled in a letter from the information on this website to send to Thomas Cook, but am expecting they will dismiss their responsibility.
Sorry for the lengthy story! Any help would be appreciated, I've never had to do anything like this before.

I refer to my threads of 1088 and 1882
I now have a Court date for the hearing. In their defence they quoted the case of Graham and Anor v TC That appeal was dismissed but as I see it that case was for damages not a claim for compensation which is a completely different matter. The Dist judge ordered them to supply a complete transcript of the judgement
which they have done. The DJ also suggested my case was suitable for mediation but TC have pre viously said no to this course. They have now been ordered to serve copies of all documents which they have not done previously. In their defence they said it was a technical issue on the way out and an extr. circumstance on the return flight. I have requested on 3 occasions for details but they have not responded. The Dis Judge as now directed them to include in any witness statement full details of the tech problem and the EC
One point I would like clarification on is what is classed as the scheduled arrival time is it time wheels on tarmac or when the plane
arrives at the gate.having read thread 2477 Also I believe I am correct in saying the delay is 3 hours or more and not more than 3 hours as there is obviously a
difference (EU Reg 261 refers)
I am quite used to criminal courts and county courts and their tactics don't bother me in the slightest. I get the impression some of their
documentation is compiled by novices.0 -

Hi All,
Has anyone any success with regards to this delayed flight ?
I am in the process of following this up with Thomas Cook : have had two replies thus far, both sticking by the fact that the mechanical fault that caused the delay to this flight was extraordinary and that all reasonable measures possible were taken to avoid the delay in question.
Would be great to hear from anyone who is also following up with this flight, and had any success.

Wondering if anyone has had any luck with compensation for this flight. TCX6032 Newcastle to Gran Canaria 28/06/12.
CAA upheld the complaint early May '13 but TC say they have not been advised of this. I can't get through to CAA, no reply to emails sent. What else can I do?0 -

Do you have an email or letter from the CAA? Send it to TC, with notice that you will start legal action within 14 days if they do not agree to settle in full.0 -

Just called TC on the off chance...CAA have notified TC and compensation is winging its way to me via bank transfer (they are no longer issuing cheques)!
