    Hoping someone can help.

    We flew to Orlando Sanford with Thomas Cook and both flights were very poor and long delay (especially return).

    Is anyone able to advise if we can make claim?

    Our outbound flight (TCX0472) was due to fly out on Friday 28th June at 9.50am, it was delayed to 11.45am, but never actually flew out till 12.30pm. Also there was no flight entertainment at all during the duration of the flight due to it being out of order. We received a free drink.

    On our Inbound Flight (TXC0473) we were due to fly out on Friday 12th July at 3.50pm, we never flew out to 2.15am on 13th July, the reasoning was a technical issue with both weather detecting instruments in the plane. We also never received our Dinner which we had paid for because we were asleep, only my wife got hers. Yet they left the 2nd snack (Muffin and Orange Juice) for us all even though we were asleep still? We received a $12 voucher each for refreshments (which was lucky to get you a sandwich and drink) and then several hours later we received a $8 voucher each.

    Not that I'm sure they'd take responsibility for this too, but due to the time we got back to Manchester (and a very long wait to our bags were loaded) during our drive home we hit a serious accident that had happened at 1.30pm on the M74 which results in a 1.5 hour delay for us too, when we would have been well home by then seeing as we were scheduled to get to Manchester around 5.10am.

    Can anyone advise if we have a claim?

    On the outbound flight, if your delay on arrival was less than 3 hours, you have no claim for compensation. On the return leg, it sounds like you do have a claim - you were delayed over 3 hours for a technical failure - which would be 600 Euros per person. The stuff about entertainment, missed meals and car accidents is irrelevant for these purposes.

    Have a read of the FAQs on page one, as well as the experiences of your fellow travelers. You may need to take TC to court to get the compensation however: they seem quite resistant. But write to them and see what they say.

    Is this still the case for non-EU flights though? I read somewhere about 600 Euros and stuff, but it related to EU regulations.

    Not sure how this works with US to UK flight?

    Would you mind me asking which no. You rang. The CAA told them to pay me a few months ago & they have completely ignored it. Waiting to hear from the court but it might be worth a call, save on any more court costs

    MCOL submitted today.
    I am quite prepared to 'see this one through' but may need to come and ask for help if I get stuck.
    I am certain that EC cannot be claimed for our flight mostly because the aircraft broke down on the previous flight (i.e. the inbound leg of the flight before the plane was due to become the outbound-inbound flight that we were on).

    I have sent Thomas cook all the details of my flight delay from Newcastle to Sharm in aug 2010 including times , flight number and dates . They replied asking for same info saying I hadn't sent it but I had kept a copy and know this was wrong .. I resent it and they have replied saying using flight number and dates etc they have no record of us on that flight ad they requested my boarding pass or ticket , I have neither as it was 3 years ago ...I have sent a coy of my invoice as provided by travel agent will this e enough ???

    Yes it should be. It is up to them to prove you were NOT on the flight. If you are telling the truth which I do not doubt they will not be able to use that as their defence.
  • Hoping someone can help? On the 3rd of July I went to Dalaman from gatwick, when we checked instead 6am as our flight was meant to be at 9 am; we were told we would be delayed 5 hours. About 9/10am the board changed to "more info at 17.00" - instead of 14.00.. We were then told that our plane was in Manchester and waiting for parts to be flown in from Germany, and that it had been there overnight!! At 17.00 we were given our flight time being 18.30. So 9 and half hour delay.. I'm about to e-mail Thomas cook and I have the proof of the delay which we were given when we landed. But from reading comments on this how do I prove I was on the flight?

    we were on that same flight and will be making a claim, did you get your letter from the TC rep when we landed in Manchester?
