    Hi all,

    This is my very first post on mse forums but I have been reading with interest regarding Thomas Cook flight delays, and following advice from some very informative helpers on here. So thank you all for taking the time to help others like me and my partner.

    Mr. Sold and Asenath1, We were on the same flight from Goa to Manchester on 4th Feb 2013, with 16 hr delay.

    Our story so far,
    05/03/13 - Sent first email of intention to claim.
    17/03/13 - Received email back stating blah blah similar to car maintenance.
    19/03/13 - Sent email NBA with the added paragraph : -

    Thank you for your email dated 17th March, in which you state, and I quote, “I can see that passengers were provided with welfare during this time, which deemed appropriate for the length of your delay.” I am deeply disappointed with Thomas Cook by this reply, as I explained to you in my previous letter that we weren’t offered anything to eat or drink for 8 hours; I personally don’t feel that is duty of care to your passengers.

    31/03/13 - TC couldn't help and should contact CAA if I wish to take it further.
    15/05/13 - Emailed TC for 2nd req of tech details.
    17/05/13 - TC issued with notice from courts.
    20/06/13 - Received notice of proposed small claims track. Plus TC's defence.

    The question I would like to ask is, It only has my name as claimant but is addressed to both of us, I thought I'd added both. TC put in their defence that they will only deal with me in the courts. does this mean I have to file again under my partners name & pay another £70 for him? I went online through MCOL to make my claim. Does anybody know if I can add his name online? Thank you

    If you have inserted the correct monetary amount, for both passengers, that were on the same booking, then the claim via MCOL is you (as lead passenger) for the total compensation due under that booking reference.

    Unless the judge decides otherwise ;)

    On the 13/06 we had an offer of compensation in the form of vouchers via email.

    i emailed back and told them we want this in the form of a cheque as we are entitled to. Still no reply to this email and my follow up on the 24/06.

    Should I wait longer or take it to the next stage?

    Well its all part of the TC game to string people along for as long as possible. Write to them stating that under EC 261/2004, Article 7 you are entitled to cash, electronic bank transfer, or cheque, and if they don't pay up within 14 days, you will start legal proceedings

    Good news that your case is resolved. I'm at the pre-MCOL stage having had my NBA letter ignored by TC. Having gone through all the correct procedures quoted on this forum, I have to say that I'm getting cold feet at having to submit a court claim. (Have heard a few cases are being thrown out) and therefore wonder what the cost implications would be if I lose? Any comments/help would be much appreciated!
    p.s. I still feel my case is a valid one so would like to progress further.

    Think they closed that down, if you want to serve a legal document, I would send it to their registered head office, sorry don't have it to hand, but it is in Peterborough

    I am now ready to go to MCOL with my claim but have two questions (sorry if these have already been answered). We experienced 8 - 12 hour delays both outbound and inbound. Can I make one claim for both delays or do I have to do them separately (both flights are covered by one booking reference). Also neither flights are on the Flightstats website. Are there certain destinations that are not covered (we went to Cuba)?

    £60 to file mcol then another £80 if it goes to a hearing. Shouldn't really have to pay anything else,
